Councihnember Pearson stated that he could understand why Mr. Konzak would want to protect <br />his property line from being encroached on because he has had similar problems and a fence does <br />limit the amount of trespassing that occurs. As it relates to the electric fence though he would <br />prefer that it be placed 1.5 to two feet from the property line. <br /> <br />Community Development Director Frolik noted that Mr. Konzak has stated that it was more <br />important to him to denote the property line than it was to have an electric fence. <br /> <br />Councihnelnber Strommen replied that if the main purpose is to mark the property line then why <br />should they deviate from the ordinance. <br /> <br />Mayor Gamec stated that he previously was a horse owner and had an electric fence on his <br />property but it was setback from the property line. He inquired if the ordinance states that <br />el ectric fences are not permitted. <br /> <br />City Attorney Goodrich replied that the ordinance states that fencing material must be wood or <br />chain link or other material as approved by the zoning administrator. <br /> <br />Community Development Director Frolik noted that that wording was added in 2002. <br /> <br />Mayor Gamec stated that he would recommend that the fence would have a setback of at least <br />two feet from the property line to stop horses from reaching over the electric fence onto adjacent <br />properties. If the fence is already located on the property line it would have to be moved by July <br />1~' and if there is an issue with trees that have to be moved staff should be notified and the fence <br />may have to be located in a temporary location until the trees are removed. If people are <br />dumping onto the Konzak's property that needs to cease. He also recommended that only two <br />strands be electrified rather than three. <br /> <br />Councihnember Cook stated that he thought they were going down a slippery slope because staff <br />was following the ordinance, which allows them to approve other materials and then once the <br />neighborhood opposed what was approved now the Council is looking at taking away his <br />property fights. <br /> <br />Mayor Gamec: replied that it is up to the City Council to hear both arguments and make a <br />decision. He inquired if anyone on the Council was opposed to a minimum setback of two feet <br />from the property line for the exterior strand. <br /> <br />Councilmember Pearson inquired if the fence had already been installed to what the City <br />authorized. <br /> <br />Mr. Konzak replied that the fence was installed this fall within a foot of the property line. <br /> <br />Councilmember Elvig stated that he would tike to add that there be a separation from the exterior <br />strand to the electric wire. <br /> <br />Councihnember Kurak inquired as to how long Mr. Konzak would have to move the fence. <br /> <br />City Council/January 13, 2004 <br /> Page 14 of 24 <br /> <br /> <br />
