Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox,
DeLuca and Pearson. Voting No: None.

C~se #13:

Adopt Amendment To Section 170.01 Of The Ramsey City Code
Establisbiny A Moratorium On The Sitiny Of Landfill~:

Mr. Hartley stated that the purpose of the moratorium is to give the City
the opportunity to draft an ordinance that would be consistent with MPCA,
Metro Council and Anoka County regulations relating to the siting of
landfills. Agcording to state law, if Ramsey has such an ordinance in
place, then the comments of Ramsey will be taken into consideration if the
county chooses to site a landfill in the metro area. The City does not
have the right to put something in place that would interfere with the
siting process but it does have the right to make reasonable requirements
on construction and operation of a landfill.

Motion by Councilmember Sorteberg and seconded by Councilmember Cox to
adopt Ordinance ~88-7 establishing a moratorium on the siting of landfills
in Ramsey. (Refer to ordinance file for Ordinance #88-7).

Further Discussion: Councilmember Cox inquired if this ordinance conflicts
with the agreement the City entered into for vertical expansion of the
landfill. Mr. Hartley stated that the proposed ordinance affects the
siting of landfills and the agreement with Waste Management applies only to
the expansion and operation of an existing landfill.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox,
DeLuca and Pearson. Voting No: None.

Case #15: ~olunteer Fire Department No Smokin~ Policy;

Mr. Hartley stated that the Fire Safety Committee is recommending that
Council adopt a no smoking policy for all members of the Ramsey Volunteer
Fire Department. A Minnesota statute states that firefighters unable to
perform duties in the department by reason of a disabling cancer of a type
caused by exposure to heat or suspected carcinogen is presumed to have an
occupational illness. The Fire Safety Committee feels that due to the high
exposure to heat, smoke, and other carcinogens firefighters may experience,
and the increased risk of smokers contracting a related disease, a no
smoking policy would minimize the dollars spent on Workers' Compensation
claims made due to non-job-related illness. The concerns of the Fire
Safety Committee are that to adopt this policy may affect the number of
people that will be eligible to be volunteer firefighters; to not adopt the
policy leaves the the city's worker's compensation insurance very
vulnerable to claims.

Motion by Councilmember DeLuca and seconded by Councilmember Cox to adopt
Resolution ~88-125 to establish a no smoking policy for all members of the
Ramsey Volunteer Fire Department. (Refer to resolution file for Resolution
#88-125).
City Council/July 12, 1988
