Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />approve pay estimate #6 to Dave Perkins Contracting in the amount of <br />$10,719.08 rather than $10,385.19. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers $orteberg, Cox, <br />DeLuca and Pearson. <br /> <br />Mr. Goodrich noted that there was an arbitration hearing on July 11 at City <br />Hall between the City of Ramsey and Dave Perkins Contracting regarding a <br />difference of opinion in what is considered specific ditch work and what is <br />considered common excavation in the River's Bend Plaza project. Both sides <br />are to present briefs in writing by August 3 and the aribtrator will make a <br />decision after that. Dave Perkins Contracting is requesting $13,600 for <br />additional excavation, $1,000 for interest and $850 for arbitration costs. <br />The City has offered nothing. <br /> <br />Case #1!: 153rd Avenue Right-Of-Way Plans T.H. No. 10 TO And:ie <br /> Improvement Project #88-21: <br /> <br />Mr. Hartley stated that the City has received an order from the <br />Commissioner of Transportation to establish a public railroad crossing <br />where the extension of 153rd Avenue would intersect with the railroad <br />tracks; the City also received an order from the Transportation Regulation <br />Board to close Puma Street. The first step in accomplishing all this is to <br />develop right-of-way plans. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to adopt <br />Resolution #88-124 ordering preparation of right-of-way plans for <br />Improvement Project #88-21. (Refer to resolution file for Resolution #88- <br />124). <br /> <br />Further Discussion: Councilmember DeLuca stated that the right-of-way will <br />include the parking lot of one parcel; will that require relocating their <br />access: Mr. Hartley stated that part of the city's cost in this right-of- <br />way acquisition will.include relocating that access onto 153rd. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Case ~12~ Introduce Ordinance Regulating Charitable Gambling: <br /> <br />Council reviewed the proposed ordinance to regulate charitable gambling and <br />asked staff to research whether or not it is a State law that prohibits the <br />consumption of alcoholic beverages in the same room where bingo is being <br />played and that gambling cannot be conducted from a counter or bar or other <br />area where alcoholic beverages are sold for consumption. Council directed <br />that the 3 year criteria for organizations demonstrating a service in <br />Ramsey be changed to 2 years. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to <br />introduce Ordinance #88-X regulating charitable gambling. <br />City Council/July 12, 1988 <br /> <br />Page 9 of 12 <br /> <br /> <br />
