Board Member Valentine stated that he would also think it beneficial to include salt, which <br /> would occur over winter but recognized that the Pollution Control Agency (PCA) simply <br /> regulates phosphorus. <br /> City Engineer Westby noted that the PCA is beginning to focus on chlorides as well. <br /> Board Member Hiatt questioned the impact that the amendment would have on the identified <br /> areas. <br /> City Engineer Westby explained that the amendment would allow for additional infiltration <br /> efforts in a larger area of the City. <br /> Board Member Lewis questioned the economic impact. <br /> City Engineer Westby stated that he did not have a concrete answer for that question but <br /> explained that there would be a cost savings to the City and other developers within the COR <br /> because of the amendment to the infiltration boundary. He stated that he did confirm that this <br /> amendment would comply with the State requirements. <br /> City Planner Anderson noted that the Ordinance had been drafted in 2006 and was amended in <br /> 2013. He advised that these amendments bring the City's regulations in line with the 3rd <br /> Generation Plan from the LRRWMO and also with the requirements from the State. <br /> Councilmember Kuzma explained that the LRRWMO is already budgeting to draft a new <br /> version of their Plan within the next few years and the City uses that as a framework to draft <br /> their Ordinance. <br /> Motion by Board Member Valentine and seconded by Board Member Hiatt to recommend that <br /> the City Council adopt Ordinance #14 -09 amending City Code Section 117, Article II, Division 6 <br /> — Performance Standards, Subdivision II — Stormwater Pollution Control. <br /> Motion carried. Voting Yes: Chairperson Stodola, Board Members Valentine, Hiatt, Bernard, <br /> and Lewis. Voting No: Board Member Bentz. Absent: Board Member Prendergast. <br /> 5.02: Receive Update on Minnesota Department of Natural Resources' Mississippi River <br /> Corridor Critical Area (MRCCA) Rulemaking Project and Consider Official <br /> Response <br /> City Planner Anderson presented the staff report. <br /> Community Development Director Gladhill provided additional information on the creation of <br /> the Mississippi River Corridor Critical Area (MRCCA) and the rulemaking process of the DNR. <br /> He provided a brief summary of the rulemaking process and draft amendments proposed by the <br /> DNR and asked for input from the Board regarding the proposed draft response from the City. <br /> Board Member Valentine stated that he did not feel that he had the appropriate experience with <br /> this matter to provide a detailed response. <br /> Environmental Policy Board / August 4, 2014 <br /> Page 3 of 7 <br />
