Council directed City Staff to draft an ordinance setting hours of opeation for those establishments that offer billiards and amusement games. ~ Pave Perkins Contractin_~. Inc./City Of Ramsay Arbitrators: Mr. Goodrich reported that Dave Perkins Contracting invoked arbitration relating to construction contract for site improvements at River's Bend. The arbitrator found against the City. Mr. Hartley reported that Hakanson Anderson Associates has offered to pay one half of the costs incurred by Ramsey as a result of the arbitrator's decision. Motion by Councilmember Sorteberg and seconded by Councilmember DeLuca to authorize the finance director to issue a check to Dave Perkins Contracting, Inc. in the amount of $14,701.73 plus accrued interest through October 26, 1988, pursuant to the American Arbitratiom Association Award dated October 11, 1988. Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, DeLuca, Pearson and Bawden. Voting No: None. Councilmember DeLuca stated that he would like a determination as to whether or not there is fault with the bid specs or the bidders; if there is fault with bid specs, it should be corrected. Mr. Hartley replied that the specs were reviewed and seemed to be adequate; during the course of construction there were indicators that suggested the contractor did not have a full understanding of contract responsibilities. It is in Ramsey's best interest to re-evalutate whether or not standard arbitration will be used to resolve disputes affecting contract interpretation in the future. Motion by Councilmember $orteberg and seconded by Councilmember Pearson to accept the offer of Hakanson Anderson Associates to pay 50% of the costs incurred by Ramsey as a result of the arbitrator's decision in the Dave Perkins case. Motion carried. Voting Yes: Mayor Reimann, Councilmembers $orteberg, DeLuca, Pearson and Bawden. Voting No: None. Discussion R~ardinf PrEliminary Plat Approval Of Green Valley Estates 2nd Addition: Mr. Raatikka ~tated that about a month ago, Council approved Green Valley Estates 2nd Addition contingent upon Mn/DOT approval of accesses. Mn/DOT will not approve one of the proposed entrances and the plat has been redrawn accordingly but it is not acceptable to City Staff. Mn/DOT was again approached but they maintain their position of limiting access onto Hwy. #47. Mr. Bauer and Staff have come up with another alternative which includes providing an easement for future street extension that will align with 179th. City Council/October 25, 1988 Page 16 of 18
