Ramsey is a home rule city and has a charter
which spells out procedures for public improvements. Burns Township is an
urban township and public improvements for that township fall under
Minnesota Statute 429. The procedure for 429 is that if there are 33% of
the front footage represented by a petition, than the township must
consider whether or not to do a public improvement. Chapter 429 also
requires a public hearing. In Ramsey, the same number of signatures are
required ~'o consider a public improvement but for the public improvement
to go forward, there are different requirements. If there is opposition to
the improvement, then the number of signatures on the favoring petition
have to be greater than the number of signatures on the opposing petition.
Those that are permitted to sign a petition are persons who are property
owners; one signature per property owner is all that is permitted,
regardless of how much property is owned in the subject area.

Mr. Hartley stated that Ramsey has received a petition opposing the
proposed improvement project that contains names of individuals in Ramsey
Public Hearing/December 8, 1988
