CASE <br /> <br />REQUEST TO REZONE CERTAIN PROPERTY FROM R-1 RURAL RESIDENTIAL <br />TOR-1 URBAN RESIDENTIAL; CASE OF K. C. LAND COMPANY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />K. C. Land Cgmpany is requesting a rezoning of property proposed located north of 153rd <br />Avenue NW ar)d West of Sunfish Lake Boulevard proposed to be platted as Alpine Estates. The <br />rezoning would facilitate the development of single family urban lots on the property. <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff sent hearing notices to owners of property in excess of the 350 foot <br />requirement. <br /> <br />Observations: <br /> <br />The property is approximately 21 acres in size and is in the Metropolitan Urban Service Area <br />(MUSA). Th~ proposed preliminary plat accompanying the application proposes to develop the <br />parcel with s~gle family homes. The adjacent parcels to the north are zoned rural residential. <br />The parcel on the south side of 153rd Avenue NW is a park. The Comprehensive Plan <br />amendment initiated in 1993 and approved in 1995 puts the subject property in the MUSA for <br />residential development. <br /> <br />Certain community residents are of the opinion that the MUSA has not been expanded to include <br />all of the subject property. However, Staffis &the opinion that this is not a correct position. In <br />response to thi~ position, the City Council has directed the City Attorney to review this issue and <br />advise accordingly. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Proposed preliminary plat <br /> c) Proposed Findings of Fact ~/.. ~A,C,~· ~c¢~ <br /> d) Proposed Ordinance ,O~3. ~/~-~'~ ~' <br />Recommendation: <br /> <br />City Staff recommends approval of the request for rezoning as the definition of R-1 Rural <br />Residential zoning is in conflict with the intent of property in the MUSA. <br /> <br /> <br />
