Mr. OttostateO In checking with the City of Anoka, he was tolO that Mr,,Rybhner didn't have a CUP anO that they haO not been aware of the business operating on the property. He undermtood that the City has!met with Mr. Rychner and ham asked him to leave. Mr. Rychner stated no one has asked him to leave the City of Anoka. He did not have a permit because he did not own the land. He tried to buy the ]and until he found out It was mold to someone else. That Is When he started to look elsewhere to locate him business. VOTE ON MOTION: YES-Deemer, LaDue, Zlmmerman; NO-Hendrlksen, Thorud; ABSENT-Bawden, Terry. Motion carried. MOTION by Hendr]ksen, Seconded Dy Thorud, add Item 14a, the current business has operated on the former H & S property without a con~ltllonal use permit. FURTHER DISCUSSION: Commissioner Hendriksen felt that is a fact, and It makes no inference to anything!beyond that. Chairman Zlmmerman and Commissioner Deemer both felt the statement implies that a permit Is needed, and they do not know that that Is a fact. VOTE ON MOTION: YES-Hendriksen, Thorud; NO-Deemer, LaDue, Zlmmerman; ~BSENT-Bawden, Terry. Motion failed. MOTION DX Hendriksen, Seconded by Thorud, add Item 14a, the consu]tah~t to the C]ty of Ramsey has stated in his opinion the City of Anoka Was asking the applicant to move his business from Anoka. VOTE ON MOTION: YES-Hendrlksen, LaDue, Thorud; NO-Deemer, Zlmmerman; ABSENT-Bawden, Terry. Motion carries. In discussing Item 20, Mr. Otto explained It is reflecting the fact that Mr. Rychner has submltted a slte plan indicating he will have Areas A and B separated by fences and Area B would be screened. It Is somewhat unusual In that the ordinances do not address the proposal of setting up a production line outside. Referencing Item 19, Mr. Rychner stated he will purchase aluminum cans and melt them; however, he will be looking into that process further after the first of the year. Right now the bigger companies'are flooded with aluminum cans and ~o not want to deal with him. Commissioner Deemer again questione~ the definition of "abuts" as written in Item 21. MOTION Dy Deemer, Seconded by Thorud, for the City Attorney to clarify t~e situation on whether the property abuts the highway or the zone, bearing in mind ail the legal ramifications.
