the application, including performing background checks into criminal <br />history, contacting references, and determining, to the extent reasonable, <br />the veracity of the information contained in the application. Following <br />completion of that process, the Chief of Police shall make a written <br />recommendation to the City Council as to the issuance or non -issuance of <br />the license. <br />(2) Upon receipt of a massage establishment application, the building <br />official shall immediately institute an inspection of the premises in which <br />the massage establishment is or will be located for compliance with the <br />City of Ramsey building code, and the building -based regulations in this <br />Article. Following completion of that process, the building official shall <br />make a written recommendation to the City Council as to the issuance or <br />non -issuance of the license. <br />(3) The City Council may determine that further or additional investigation <br />is required, and may order such investigation. The City Council shall act to <br />approve or deny an initial application for a massage establishment license, <br />or an application for a lapsed massage establishment license, within a <br />reasonable period, and in no event later than 60 days from the date the <br />completion of all investigations and inspections, including any required by <br />the City Council. <br />(4) The city council shall act to approve or deny an initial application for a <br />massage therapist license, or an application for a lapsed massage therapist <br />license, within a reasonable period, and in no event later than 120 days <br />from the date the application was accepted as completed by the City Clerk. <br />(g) Each applicant for a license under this Article, whether for a massage <br />establishment or a massage therapist, has a continuing obligation to update any <br />infounation provided in the applicant's application if that infounation changes. <br />Section 26-854. Fee and Term. <br />(a) Application, inspection, and investigation fees may be set from time to time by <br />ordinance of the City Council. <br />(b) Each license granted under this Article is for no more than a one year term, <br />with such term beginning on January 1 and ending on December 31. <br />(c) If any license granted under this Article is revoked or suspended, no portion of <br />any application, inspection, or investigation fee shall be refundable or reduced pro <br />rata. <br />(d) No license application, inspection, or investigation fees under this Article will <br />be prorated or refunded. <br />9 <br />
