Broad prohibition on substances: this is meant to provide a broader set of <br />circumstances in which a license could be revoked, if desired by the council. <br />There are some acts that are prohibited by the proposed language that are not <br />otherwise prohibited. For example, a person who knows that an employee is using <br />drugs on the premises or a person who is giving away alcohol to individuals of <br />legal age. But, if a business owner knows of the drug use, or permits alcohol to be <br />given away, the council has discretion to revoke the license. This is a broad set of <br />tools for police and the council. <br />10. Maintain list of employees: this is meant to target human trafficking issues, like <br />the employee information provided with the application. This is also meant to <br />ensure that the employees of the business are licensed, as appropriate. This <br />requirement is contained in some of the nearby community ordinances. It may <br />also be notable that Pawnbrokers are required to report certain transactions to <br />police daily. See Ramsey City Code § 26-493. <br />11. Cleanliness requirements: to the extent that a business is operating as a <br />legitimate business providing therapeutic massage services, providing clean towels <br />and sheets appears to be a warranted requirement. The building and cleanliness <br />requirements of other nearby ordinances appear more onerous, including building <br />requirements for sanitary coves and wall materials. <br />12. The Massage Therapist ordinances of many nearby communities require a certain <br />number of hours of training in order to be licensed. The draft ordinance does not <br />include this, but it could be added, if desired. The concern is that it is unknown <br />how many hours is an appropriate number to require. Anoka requires 150 hours of <br />training from a registered school, and Andover requires 500 class hours and 200 <br />clinical hours. Coon Rapids separately regulates massage parlors (and the <br />employees thereof) and therapeutic massage therapists. The latter must complete <br />400 hours of training from a school approved by the City. It is unknown if these <br />numbers are arbitrary, or based on a particular standard. <br />13. The dual structure of the Coon Rapids ordinances may be an option to distinguish <br />trained and certified massage therapists from less legitimate masseuses. <br />RRM: 189658 <br />
