Chairperson Levine closed the public hearing closed at 7:11 p.m. <br />Commission Business <br />Commissioner VanScoy asked if the third driveway would require a variance. <br />City Planner Anderson stated this request was a provision within the variance being considered <br />this evening. <br />Motion by Commissioner VanScoy, seconded by Commissioner Maul, to adopt Resolution #14- <br />10 -206 approving Findings of Fact #0936. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners VanScoy, Maul, Bauer, and <br />Nosan. Voting No: None. Absent: Brauer. <br />5.03: Public Hearing: Consider a Request for a Variance to Allowable Fence Height in the <br />Front Yard Setback Area at the Property Located at 5859 Alpine Drive NW; Case <br />of James and Patricia Hirschman <br />Public Hearing <br />Chairperson Levine called the public hearing to order at 7:13 p.m. <br />Presentation <br />Planning Intern Olson presented the staff report stating the City received an application for a <br />variance to the height limit for fencing within the front yard setback of the property located at <br />5859 Alpine Drive NW, which is within the R -1 Residential (MUSA) district. The variance <br />would allow the property owner to deviate from standards described within City Code Section <br />117 -111 (R -1 Residential) to construct a six (6) foot high privacy fence along portions of the <br />property's front yard, exceeding the height limit by two (2) feet. The request was prompted by <br />the loss of trees that stood where the fencing is being proposed. Those trees were removed as a <br />result of the reconstruction of the intersection immediately adjacent to the property. Staff <br />reviewed the case in further detail with the Commission and recommended approval of <br />resolutions related to the request for a variance to the height limit for fencing within the front <br />yard setback of a residential property. <br />Planning Commission /October 9, 2014 <br />Page 4 of 14 <br />
