CASE # 3 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH AN <br />AUTO REPAIR/TOWING SERVICE/NEW PARTS SALES FACILITY AT <br /> 1~t600 NOWTHEN BLVD. N.W. (PIN #25-32.25-23-0006); <br /> CASE OF FRED DINNETZ OF ATH, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may know, in January of this year the City Council revoked a conditional use permit for <br />auto sales and repair at 14600 Nowthen Blvd. N.W. The primary reason the CUP was brought <br />before City Council was that the permit issued allowed for repair of only those autos that would be <br />for sale on the property. About one year ago, Gerald Root leased the property to Fred Dinnetz of <br />ATH and the primary use of the site was auto repair, not just repair of cars that would be for sale <br />on the prope ,r~y. After many attempts to get Mr. Root to apply for an amended conditional use <br />permit failed, the City Council revoked the permit for non-compliance. <br /> <br />Mr. Dinnetz of ATH was present at the Council meeting in which this revocation action took place. <br />Upon inquiryas to the options available to him in order to maintain his auto repair business at <br />14600 Nowthen Blvd., City Council informed Mr. Dinnetz that he would have to apply for a <br />conditional use permit and in the interim, it would be in his best interest to improve the condition of <br />premises. Based on Council's response, Mr. Dinnetz of ATH has applied for a conditional use <br />permit for auto repair/auto towing service/new pans sales on the subject property. In doing so, he - <br />has had a site plan drawn up, initiated site clean up efforts, and is seeking to purchase the property <br />from Mr. Root. <br /> <br />Observations: <br /> <br />The applicant:has submitted a site plan which proposes a number of property improvements. They <br />include a dumpster enclosure, a tire storage area enclosed by a 6 foot opaque wooden fence, a <br />20'x45' cold Storage addition to the principal structure, impound lot encompassed by a 6 foot <br />opaque wooden fence, and bituminous surfacing of the driveway and off-su:eet parking area. <br /> <br />The site is bounded on the south by R-3 Urban Residential zoning and on the west and north by R- <br />1 Urban Resident/al. In accordance with City Code, the site would be required to provide a 5 foot <br />high screening and a 40 foot wide landscaped yard on the west and the north property lines. A 5 <br />foot high screening would be required on the south property line.
