Subd. <br /> <br />3 <br /> <br />The owner of the property upon which the sign is located shall be presumed to be <br />the owner of all signs thereon unless facts to the contrary are brought to the <br />attention of the Zoning Administrator. <br /> <br />Subd. 4 <br /> <br />In case of emergency, the Zoning Administrator or Building Official may cause the <br />immediate removal of a dangerous or defective sign without notice. Signs removed <br />in this manner must present a hazard to the public safety as defined in the State <br />Building Code. <br /> <br />9.12.24 APPEALS <br /> <br />To provide for a reasonable interpretation of the provisions of this ordinance, a permit applicant <br />who wishes to appeal an interpretation by the Zoning Administrator may file a written appeal with <br />the City Adrrdnistrator and reqeust a hearing before the City Council. The City Council shall hear <br />the appeal, make findings and take its action. <br /> <br />9.12.25 VARIANCES <br /> <br />Requests for variances from the provisions of this section shall be processed by the applicant <br />applying to the Zoning Administrator for a conditional use permit. <br /> <br />9.12.26 CONFLICT <br /> <br />If any portion of this section is found to be in conflict with any other provision of any zoning, <br />building, fire, safety or health ordinance of the City Code, the provision which establishes the <br />higher standard shall prevail. <br /> <br />9.12.27 SEVERABILITY <br /> <br />If any section, subsection, sentence, clause, or phrase of this code, or its application to any person <br />or circumstance is held invalid by the decision of any court of competent jurisdiction, the remainder <br />of this code, or the application of the provision to other persons or circumstances is in effect and <br />shall remain in full force and effect. <br /> <br />9.12.28 PENALTY <br /> <br />Any person violating any provision of this Chapter is guilty of a misdemeanor and upon conviction <br />shall be punished by a fine and/or imprisonment~ <br /> <br />9.12.28 EFFECTIVE DATE <br /> <br />That this ordinance shall take effect and be in full force 30 days after the date of its publication. <br /> <br />Draft Date March 30, 1992 <br /> Page 19 of 19 <br /> <br /> <br />
