Councilmember for its adoption: introduced the following resolution and moved RESOLUTION q~) 1-04- A RESOLUTION APPROVING THE ISSUANCE OF AN AMENDED CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, 1NC (as of 4/8/91) On , 1991 a conditional use permit ("CUP") was issued by the City of Ramsey ("City") to Danny's Aluminum Processing, Inc. ("Permit Holder") to operate an aluminum prOCessing facility in the I-1 Industrial District on 1.6 acres of land legally described as follows: Lot 1, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota, hereinafer "site". This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as follows: Term, This permit shall remain in effect so long as the conditions imposed herein are complied with. Noise. Noises emanating from the site and operations shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. Dust/Ash/Particulates. The emission of dust, ash or other particulate matter shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Part 50, as mended except as modified herein by City performance requirements. Odor. The emission of odor from the operation shall be in compliance with and regulated by the:State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as modified herein by City performance requirements. Smoke. The emission of smoke from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0480 subp. 1.B., as amended except as modified herein by City performance requirements. Furnl~e¢ Emissions and Monitoring. Emissions from the melt furnace shali comply with State ~d Federal regulations as they exist and may be modified from time to time during the period of this CUP. An independent testing laboratory shall conduct emissions monitoring at least once per year or on a more frequent basis if pollutants are in excess of standards. The Permit Holder shall make a complete report available to the City within thirty (30) days of completion by the testing laboratory. At a minimum, the parameters of such emissions monitoring shall include the following State and Federal criteria pollutant emissions as may exist from time to time during the term of this permit.
