The Permit Holder agrees to screen the aluminum processing facility from any <br />public street. Such screening shall be achieved using grading, landscape elements, and/or <br />plant materials which will achieve up to 90% opacity. Supplemental screening of the Site <br />may be ordered by the City to comply with the then current screening requirements for <br />outside storage on industrial property. <br /> <br />Off-Street pgrking. Off-street parking shall be provided such that there is at least one <br />parking space for each employee on the maximum working shift plus three spaces for <br />visitor parking. <br /> <br />Surfacing of Work Areas. All storage areas, parking areas and driveway areas shall be <br />surfaced with bituminous or concrete. <br /> <br />Structures and Silce Improvements, The placement, design and construction of new <br />structures or additions to existing structures and site improvements shall comply with City <br />Code as provided within the Site Plan Development Permit, and applicable state codes and <br />OSHA requirements. <br /> <br />Building Permits. No construction or remodeling of any structures shall commence prior <br />to the issuance of a building permit by the City Building official and site plan approval by <br />the City Council. <br /> <br />Sanitary Sewer. The Permit Holder shall f'fle an amended petition for City sewer and water <br />within 30 days of the date of action on this CUP. In the event that the petition fails, the <br />Permit Holder shall install an on-site system or submit an alternative sewage handling <br />treatment plan for Council approval. <br /> <br />Scope and Conduct of Operations. The operations permitted by this CUP may be <br />performed on the Subject Property in conformance with existing statutory and regulatory <br />authority and requirements of the City, Anoka County, Minnesota ("County"), and the <br />Minnesota Pollution Control Agency ("MPCA"). <br /> <br />.Hours of Operation. The Permit Holder may conduct receiving operations within the hours <br />of 7:00 a.m. to 8:00 p.m., Monday through Saturday, and may conduct aluminum melt <br />operations 24 hours a day, seven days a week unless the operations present a nuisance or <br />disturb neighboring land uses. The City Council may limit hours of operation to protect <br />neighboring land uses. <br /> <br />Furnaces. An increase in furnace capacity or a third melt furnace shall not be added to the <br />operation without application and approval of a new CUP. <br /> <br />Closure D.~e to CUP Revocation, Other Circumstances. In the event this CUP is revoked <br />or the Permit Holder closes operation of the aluminum processing operation for any reason, <br />including but without limitation, order of the court or other agency of competent <br />jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall immediately <br />proceed to remove all feedstock and other material from the site. In the event the Permit <br />Holder fails to comply with the terms of this CUP, the City may, upon 30 days' written <br />notice to the Permit Holder enter into the property and perform ail such obligations, the <br />costs of which shall be borne by the Permit Holder or, in default thereof, by its surety. <br /> <br />Financial Assurance.
