<br />In rear yards: recreational and laundry dr)-lng equipment,
<br />arbors and trellises, balconies, breezeways, open porches,
<br />detached outdoor living rooms and private garages, providing a
<br />setback of 5 feet or the depth of any existing easements, whichever
<br />is greater, is maintained;
<br />
<br />Height limitations shall not apply to barns, silos, and other
<br />structures on farms, church spires, belfries, cupolas and domes,
<br />monuments, water towers, fire and hose towers, observation
<br />towers, chimneys and smokestacks, flag poles, telephone poles,
<br />and parapet walls not extending more than four feet above the
<br />limiting height of the building.

<br />9.11.16 Height Regulations. No principal structure shall exceed 35 feet in
<br />height abov~ average ground level.

<br />9.11.1 7 Fences. Fences shall be located entirely on the owneFs property and
<br />the fence location and placement shall be the owner's responsibility. Fences shall
<br />be located s~ch that they do not interfere with traffic visibility.

<br /> i: Subdivision L Purpose. The purpose of this section is to safeguard
<br />life, limb, property and the public welfare by controlling grading, m~ning, and
<br />filling opera, tions so as to m~nim~ze conflicts with adjacent land uses, to preserve
<br />good soils and to regulate the type of materials used in filling operations, and to
<br />ensure that idisturbed areas are restored upon completion of the operation.

<br /> Sub&2. Scope. This section sets forth rules and regulations to
<br />control grading, m~ng, excavation, and earthwork construction including fills
<br />and emban~ ents, establish the aSm~uistrative procedure for issuance of permits,
<br />and provide~ for approval of plans and inspection of grading construction.
<br />
<br /> Subd. 3. Exceptions. This section shall not apply to:
<br />
<br /> 1. The excavation, removal, or storage of rock, sand, dirt, gravel,
<br /> clay, black dirt, peat, or other like material for the purpose of
<br /> compliance with a grading plan approved as part of a subdivision
<br /> plat, site plan, or planned ~mit development, if said plat, site plan
<br /> or planned ~mit development does not requ/re the exporting of
<br /> earth material, or for the purpose of the yard, foundation, or
<br /> basement of a b~dlding in the process of being erected, built, or
<br /> placed thereon contemporaneously with, or immediately
<br /> following, such excavation, removal or storage.
<br />
<br /> 2. The excavation, removal, or storage of rock, sand, dirt, gravel,
<br /> clay, black dirt, peat, or other like material by a public agency
<br /> incidental to the construction or maintenance of streets or
<br /> utilities.
