CASE # ~" <br />REQUEST,TO VACATE OUTLOT B IN COUNTRYSIDE ESTATES ADDITION <br /> By: .lames Gromberg, Project Manager <br /> <br />Background: <br /> <br />Wright Tire Company in Elk River has requested that the City of Ramsey vacate the northern half <br />of Ouflot B in!' Countryside Estates. This parcel was dedicated to the City with the final plat of <br />Countryside Estates Subdivision in 1972. Unfortunately, none of the dedicated parks were <br />indicated on the final plat; they were listed as ouflots. This has lead to the list of errors outlined in <br />the City Attoraey's case for the City Council Meeting of April 23, 1991. <br /> <br />The City Council has directed the Planning and Zoning Commission to hold a public hearing, <br />review input and make a recommenciation to the City Council. <br /> <br />The City Attorney has reviewed State Statutes and has indicated in his letter that the dedicated <br />property would return to the original person(s) doing the subdivision. In this case, it would be <br />First Guaranty Corporation. <br /> <br />City Staff has reviewed the situation and concluded that with the purchase of the three acre tract in <br />Windsorwoo&Addition for park space, the City should vacate the dedicated parcel to the original <br />developers.
