Councilmember Pearson moved the adoption of the following findings of fact: <br /> <br /> FINDINGS OF FACT #0289 <br /> AMATEUR RADIO TOWER <br />PIN 16-32-25-43-0008 <br />15705 TRAPROCK STREET N.W. <br />as of 12/4/90 <br /> <br />That Howard Rohs and James Monson, hereinafter referred to as "Applicants", have <br />properly applied for a conditional use permit to erect and maintain an eighty (80) foot <br />amateur radio tower in the R- 1 Rural Residential District. <br /> <br />That the Applicants appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 170.013D (Conditional Use Permits) on December 4, 1990 and <br />that said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />That the subject property is generally known as 15705 Traprock Street N.W. and is legally <br />described as follows: <br /> <br />Lot 4, Block 4, Traprock Commons, Anoka County, Minnesota. <br /> <br />That the subject property is approximately four (4) acres in size and is zoned R-1 Rural <br />Residential. <br /> <br />5. That the adjacent properties are also zoned R-1 Rural Residential. <br /> <br />That there are no City ordinances in place establishing districts and regulations for antennas <br />and towers and as such, they are subject to Section 170.013D (Conditional Use Permits) of <br />the City Code. <br /> <br />That the proposed radio tower would be located approximately 8,000' from the end of the <br />runway as it currently exists at Gateway North Industrial Airport. <br /> <br />8. That the City currently does not have airport safety zoning in place. <br /> <br />That Gateway North Industrial Airport is open to the public; is recognized as part of the <br />National Airport Systems Plan and as such is an airport of Federal concern and therefore, <br />subject to FAA regulations. <br /> <br />10. That the Applicants have filed a Notice of Proposed Construction with FAA. <br /> <br />That no other similar permitted conditional uses exist with_in the City; however, the City did <br />issue conditional use permits in the R-1 Rural Residential District for a 911 receiving tower <br />and a commercial Cable T.V. Antenna. <br /> <br />12. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use, or to the public welfare. <br /> <br />13. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment or market <br />value of any surrounding property. <br /> <br />14. <br /> <br />That the proposed use will be harmonious with and in accordance with any specific <br />objectives of the Comprehensive Plan. <br /> <br /> <br />
