CASE

REQUEST TO VACATE DEDICATED STREET RIGHT-OF-WAY
ACROSS OUTLOTS C AND D OF NORTHFORK ADDITION;
CASE OF NORTH FORK, INC,
By: James Gromberg, Project Manager
Background:

North Fork, Inc. is requesting that the City of Ramsey vacate certain easements that were acquired
during the platiing process of Northfork, P.U.D. The first easement across Ouflot D, connecting
153rd Avenue:N.W. with Highway #10, was acquired before the City had decided on the exact
routing of the!future connection of 153rd Avenue N.W. to Highway gl0. The City has now
connected 153rd Avenue N.W. to Highway gl0 using a different alignment than the easement that
was acquired. ~;tate Statute requires that it be found in the public interest to vacate a public street or
right-of-way. The vacation being requested is based on the City no longer having a need for that
particular alignment for a connection of 153rd Avenue N.W. to Highway gl0. It is my opinion
that the City v~cate the easement across Outlot D of Northfork Addition for the alignment of 153rd
Avenue N.W. to Highway gl0.

As for the vacation of the fight-of-way easement across Outlot C connecting Andrie Street N.W. to
164th Avenue ,N.W. in Woodlawn Estates, as indicated in the City Engineer's review letter dated
November 20, 1991, the Planning and Zoning Commission will need to receive additional input
from the developer and the Commission as to the alignment of streets in this area before it decides
whether or not[to vacate this easement. The Planning and Zoning Commission may wish to review
the City's Thoroughfare Plan to see if a street connecting these two areas is required to promote
future growth Of the City. If this is the case, the City may wish to require from North Fork, Inc.
an agreement Io connect a street into 164th Avenue N.W. but not to designate that particular
alignment for the street. Attached for your information are the following items:

1)
2)
3)
4)

iMaps showing the requested vacations
.Properties notified list for this public hearing
City Engineer's review letter to North Fork, Inc. dated November 20, 1991
Copy of Declaration of Road Easements for Northfork, County Document g145957

Recommendation:

Based upon City Engineer's review letter, City staff recommends that the Planning and Zoning
Commission recommend to City Council to vacate road easement across Outlot D.

Based upon the input from the developer and the Planning and Zoning Commission, City Staff
recommends that the Planning and Zoning Commission recommend to City Council to approve/
deny the proposed vacation of road right-of-way across Outlot C of Northfork Addition.

Commission:Action:

Motion to recommend/not recommend to City Council vacation of street easement across Outlot D
of Northfork Addition.

-and-

Motion to recommend/not recommend to City Council vacation of street easement across Outlot C
of Northfork Addition.

Review Checklist:

Project Manager
City Engineer

Zoning Administrator
Planning and Zoning Commission

City Administrator

PZ: 12/03/91
