That ~e Subject Property is approximately 3.1 acres. That t~e Subject Property is surrounded by acreage lots that are similar in size. That aust°m cabinet businesses operated within an accessory structure are not a permitted use ia the R-1 Single Family Residential District without the issuance of a HOme OccUltation Permit. That 6n December 16, 2003 the City Council adopted a Home Occupation Ordinance alloW~g residents the ability to apply for a Home Occupation Permit to operate a business within an accessory structure and employ non-resident employees as outlined in the Hc~me Occupation Ordinance. That the Applicant's property is 3.1 acres in size and therefore eligible to apply for a HomeiO¢cupation Permit to operate a business within an accessory structure and employ one n6rt-resident employee. That the accessory structure is located on the Subject Property, which contains a principal dwellit~g, That tl~e Applicant has provided a letter stating he has been operating his cabinet business on the~ubject Property for 17 years. That ~e business operation is considered illegal non-conforming and therefore the Appli~. nt submitted a Home Occupation Permit application in order to comply with City Code. Ii That thee Applicant resides and is the fee title owner of the location of the proposed home occupation2 That tlie APplicant receives approximately 2 - 3 material truck deliveries on a monthly basis; does not have customers coming to the property and therefore the use is not creatin~ excessive vehicular traffic to the Subject Property as defined in Subd. 4 Section E of th[ Home Occupation ordinance. That th~ Applicant's business hours are Monday- Friday 8:00am - 4:30pm. That the proposed use will not adversely impact traffic in the area. That tl~e proposed use is a compatible use to the residential neighborhood due to density and 10t :size iof the surrounding lots.
