4) 5) That the 4isplay or storage of motor or recreational vehicles on the Subject Property shall be restricted !o those areas that maintain the required improvements. Violation of this provision or any other provision will be cause for revocation of the motor vehicle sales license. That the pern]rittee shall be responsible for obtaining a permit from the LOwer Rum River Watershed M~agement Organization and any additional permits required by other applicable regulator: agencies. 6) That the Permittee shall provide a financial guarantee to the City, guaranteeing the construction and timely completion of the required site improvements described herein. The financial /guarantee shall be in the amount of Seventeen Thousand Eight Hundred and no cents ($1'~,800.00), which amount is 125% of the City Engineer's estimated cost of the required s!te improvements. The form and issuer of the financial guarantee shall be subject to the app,i'ova! of the City. The financial guarantee shall be deposited with the City prior to the constm, ction and installation of the second product silo on the Subject ProPe~y. U, pon total completion of the site improvements and acceptance by .City, the Permittee may request a total red~ction in the amount of the financial guarantee. 7) That this Permit shall not be considered modified, altered, changed or amended in any respect unless in v~riting and signed by the City and the Permittee. 8) That the C, ity shall have the right to inspect the premises for compliance and safety purposes annually oi' at any time, upon reasonable request. 9) That the te~ms of this Permit shall be binding upon its successors and assigns. 10) In the event the Permittee, or its successors, or assigns, violates the terms of this Permit, said violation Shall be grounds for suspension or revocation pursuant to Section 9.03.04 Subd. 9 of the City!'Code. 11) In the event any part of this IUP is declared void or unenforceable by a court or competent jurisdiction, the other provisions shall not be affected but shall remain in full force and effect. 12)That all costs incurred by the City in administering and enforcing this Permit shall be the responsibility of the Permittee.
