Councihnember Elvig commented there were announcements, negotiations between the <br />neighbors and the developer, and a public hearing was held. Everyone in the audience was heard <br />and the Council acted upon that. A connection is needed somewhere around this development <br />and it is being paid for by the developer. The meetings were announced legally and they went <br />through all the proper channels. They do not have the option now to go back and stick a trail in <br />the back yards, they have moved forward. They listened to the citizens' concerns and took the <br />trail out of their yards and that is where this stands now; the decisions have been made. <br /> <br />Mr. Stallick questioned why he received a letter about the developer wanting to tweak part of the <br />tree preserve, but did not receive a letter about the sidewalk. <br /> <br />Assistant Public Works Director Olson stated the public hearing was announced by a mailed <br />notice. <br /> <br />Mayor Gamec info~Tned Mr. Stallick to contact Mr. Olson with any questions about the <br />construction. <br /> <br />Tim Daly, 6121 145th Lane NW, stated the comment was made that the new development would <br />use the proposed sidewalk to get to school. However, any walkers would be going back a block <br />to use this proposed sidewalk. He indicated he would take the sidewalk as the lesser of two evils. <br /> <br />Mayor Gamec commented in most cases after the sidewalk or trail is put in it has been a blessing <br />to keep the kids safely off'the street. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Cook, to adopt Resolution #04- <br />02-060 approving plans and specifications and authorizing the solicitation of bids for <br />hnprovement Project 03-23, 145th Lane/146th Avenue Sidewalk Project. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Cook, Elvig, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />The meeting was recessed at 9:20 p.m. and reopened at 9:28 p.m. <br /> <br />Case #12: Consider Award of Contract for Building Demolition and Site Cleanup <br /> <br />Assistant Public Works Director Olson explained the City acquired the Morrell Trucking and <br />Chies properties in 2003 for redevelopment purposes. Staff had received a recommendation <br />from the EDA to go forward with the redevelopment of the site. Prior to reselling the property it <br />is necessary to raze the existing building and remove debris and rubble. It is important to prepare <br />the sites promptly to accommodate the development for Spring 2004.
