B-3 HighWay Bu ness Distri <br /> <br />§9~0~3 <br /> <br />11. Provisions are made to control and reduce noise. <br /> <br />12. No outside storage except as allowed in compliance with this <br /> Section. <br /> <br />13. Sale of products other than those specifically mentioned in <br /> this section be subject to a conditional use permit and be in <br /> compliance with §9.03.04 of this Chapter. <br /> <br />14. All conditions pertaining to a specific site are subject to <br /> change when the Council, upon investigation in relation to a <br /> formal request, finds that the general welfare and public <br /> betterment can be served as well or better by modifying the <br /> conditions. <br /> <br /> 15. The provisions of §9.03.04, Subd. 4g are considered and are <br /> satisfactorily met. <br /> <br />Convenience Store with Gasoline: Grocery and/or food <br />operations, with convenience gas (no vehicle service or repair), <br />provided that: <br /> <br />1. The retail sales involve uses or activities which are allowed <br /> in a B-1 District. <br /> <br />2. Convenience/deli food is of the take-out type only and that no <br /> provision for seating or consumption on the premises is <br /> provided. Furthermore, ~ that the enclosed area devoted to <br /> such activity, use and merchandise shall not exceed 15% of <br /> the gross floor area. <br /> <br />3. That any sale of food items is subject to the approval of the <br /> City Building Official who shall provide specific written <br /> sanitary requirements for each proposed sale location based <br /> upon applicable State and County regulations. <br /> <br />4. That the non-automotive sales shall qualify for and <br /> subsequently be granted on an annual food handling, license <br /> by Anoka County, or other license, as circumstances shall <br /> require, in addition to the conditional use permit. <br /> <br />5. That the approximate area and location devoted to non- <br /> automatic merchandise sales shall be specified in general <br /> terms in the application and in the conditional use permit. <br /> Exterior sales, storage, and/or displays shall be subject to a <br /> separate conditional use permit. <br /> <br />6. The hours of operation shall be limited to 6:00 AM to 12:00 <br /> PM, unless extended by the Council. <br /> <br />7. Motor fuel activities are installed in accordance with State <br /> and City standards.
