(8) To abate!nuisances and to drain swamps, marshes and ponds on <br />public o~ pri~ate property and to fill the same. <br /> <br />(0) To ~o~st~uct, reconstruct, extend and maintain dikes and <br />other flood cQntrol works. <br /> <br />(10) To construct, reconstruct, extend and maintain retaining <br />walls and area walls. <br /> <br />Subdivision 2~ Combining Improvements. An improvement on two <br />or more Streets or two or more types of improvement in or on the <br />same stree~ o= streets or different streets may be included in <br />one proceeding and conducted as one improvement. <br /> <br />PROCEDURE <br /> <br />Subdivision 1,. Petitions. Hearin_~s. Ail local improvements to <br />be paid ~o~ b~ special assessments against the benefited property <br />shall belihstituted by either, (I) petition of at least 35 <br />percent in~i number of the abutting property owners together with a <br />resoluti0ni addpted by an affirmative vote of the majority of all <br />of the COuncil, or (2) a resolution adopted by a four-fifth's <br />affirmativ~ v6te of all of the Council. The Council resolution <br />shall state the nature and scope of the proposed improvement, and <br />shall prOv'.ldelthe means to obtain a cost estimate which shall set <br />forth th~ ~os~ of the improvement both in unit price and in total <br />thereof. Upon receipt of such estimate, the Council shall by <br />resoluti°n, id~ntify all benefited property owners and shall by <br />resolutiOn~ se~ a date for a public hearing on the proposed <br />improvem~n't, setting forth therein the time, place and purpose of <br />such hea~i~g, i Such resolution shall be described in the City <br />newsletterI and published twice at least one week apart in the <br />official'n~ws~aper of the City no less than two weeks prior to <br />the date,of s~id hearing, and in addition thereto, a copy of such <br />resolutioni ~n¢luding the estimated total and annual assessment <br />cost for ,each',type of benefited property, estimated unit prices <br />and estima~ed,,total price of the improvements shall be mailed to <br />each ben~fSted property owner at his/her last known address at <br />least two ~eei~s prior to the date of said hearing. Failure to <br />give mail'e~ notice or any defect in the notice, shall not <br />invalidate th~ proceedings; however, corrections shall be <br />published at ~he earliest practical time. At such hearings the <br />City Council ~hall receive any written and oral statements, and <br />hear any !p~ti~ioners for or against the proposed improvement. A <br />period of ~ix~y days shall elapse after the public hearing before <br />any. furthe.~ ~ action shall be taken by the Council on the proposed <br />improvement, iIf within such sixty-day period, a petition against <br />such imp~oVeme_nt be filed with the Council, signed by a majority <br />of the b~n~fifi, ed property owners proposed to be assessed for the <br />improvemMn~, Or, when the improvement has been petitioned for, a <br />petition against such improvement signed by a number of the <br />benefited property owners proposed to be assessed for such <br />improvem~n~ a~ least equal to the number of those who petitioned <br /> <br /> <br />
