(8) To abate!nuisances and to drain swamps, marshes and ponds on public o~ pri~ate property and to fill the same. (0) To ~o~st~uct, reconstruct, extend and maintain dikes and other flood cQntrol works. (10) To construct, reconstruct, extend and maintain retaining walls and area walls. Subdivision 2~ Combining Improvements. An improvement on two or more Streets or two or more types of improvement in or on the same stree~ o= streets or different streets may be included in one proceeding and conducted as one improvement. PROCEDURE Subdivision 1,. Petitions. Hearin_~s. Ail local improvements to be paid ~o~ b~ special assessments against the benefited property shall belihstituted by either, (I) petition of at least 35 percent in~i number of the abutting property owners together with a resoluti0ni addpted by an affirmative vote of the majority of all of the COuncil, or (2) a resolution adopted by a four-fifth's affirmativ~ v6te of all of the Council. The Council resolution shall state the nature and scope of the proposed improvement, and shall prOv'.ldelthe means to obtain a cost estimate which shall set forth th~ ~os~ of the improvement both in unit price and in total thereof. Upon receipt of such estimate, the Council shall by resoluti°n, id~ntify all benefited property owners and shall by resolutiOn~ se~ a date for a public hearing on the proposed improvem~n't, setting forth therein the time, place and purpose of such hea~i~g, i Such resolution shall be described in the City newsletterI and published twice at least one week apart in the official'n~ws~aper of the City no less than two weeks prior to the date,of s~id hearing, and in addition thereto, a copy of such resolutioni ~n¢luding the estimated total and annual assessment cost for ,each',type of benefited property, estimated unit prices and estima~ed,,total price of the improvements shall be mailed to each ben~fSted property owner at his/her last known address at least two ~eei~s prior to the date of said hearing. Failure to give mail'e~ notice or any defect in the notice, shall not invalidate th~ proceedings; however, corrections shall be published at ~he earliest practical time. At such hearings the City Council ~hall receive any written and oral statements, and hear any !p~ti~ioners for or against the proposed improvement. A period of ~ix~y days shall elapse after the public hearing before any. furthe.~ ~ action shall be taken by the Council on the proposed improvement, iIf within such sixty-day period, a petition against such imp~oVeme_nt be filed with the Council, signed by a majority of the b~n~fifi, ed property owners proposed to be assessed for the improvemMn~, Or, when the improvement has been petitioned for, a petition against such improvement signed by a number of the benefited property owners proposed to be assessed for such improvem~n~ a~ least equal to the number of those who petitioned
