for the improvement, the Council shall not make such improvement <br />at the expense of the property benefited, unless, in the <br />meantime, there be filed with the Council a petition asking that <br />the improvement be made, signed by benefited property owners <br />proposed to be assessed for such improvement at least equal in <br />number to those who signed the petition against the improvement; <br />in such event the Council maqy disregard the petition against the <br />improvement. Any person whose name appears on a petition to the <br />Council for a local improvement, or on a petition to the Council <br />against a local improvement, may withdraw his/her name by a <br />statement in writing filed with the Council before such petition <br />is presented to tha Council or in person at a public hearing. <br /> <br />Subdivision 2. Protest Petition. Regardless of the provisions <br />in Subdivision 1, of this Section, when less than 80 percent of <br />the estimated cost of a proposed local improvement is to be paid <br />for by special assessment, excluding minor ordinary expenses <br />incurred in the course of City affairs, within the sixty-day <br />period after a public hearing has been held on the proposed <br />improvement, a petition may be filed with the Council, signed by <br />a number of voters greater than 50% of the number of registered <br />voters at the time of the last City wide election, protesting <br />against either the improvement, or the financing method, or both. <br />In this event the Council shall not proceed with the improvement, <br />as proposed. <br /> <br />Subdivision 3. ~%~L~P~. When a proposed improvement is <br />allowed under the foregoing subdivisions, the Council may proceed <br />at any time between sixty days and one year after the public <br />hearing on the improvement. However, no contract shall be let in <br />the event that the lowest responsible bid exceeds the estimated <br />cost by more than i0 percent (10%). In this event, in order to <br />implement the proposed improvement, it shall be necessary to <br />institute the proceedings for such improvements DE NOVO. <br /> <br />Subdivision 4. Reconsiderations. When a proposed improvement <br />is disallowed under the foregoing subdivisions, the Council shall <br />not vote on the same improvement within a period of one year <br />after the public hearing on said improvement. <br /> <br />Subdivision 5. Petition By Ail Owners. Whenever all owners of <br />real property abutting upon any street named as the location of <br />any improvement shall petition the Council to construct the <br />improvement and to assess the entire cost against their property, <br />the Council, may after a public hearing, as provided in Chapter 8 <br />of the Home Rule Charter, adopt a resolution determining such <br />fact and ordering the improvement. <br /> <br />Subdivision 6. Q~d~e=inE Imorovements. A resolution ordering <br />the improvement may be adopted by the Council after compliance <br />with the provisions of this section. The resolution ordering the <br />improvement may be adopted at any time between sixty (60) days <br />and one year after the date of the public hearing on the <br />improvement by vote of a majority of all members of the Council <br /> <br /> <br />
