when the '.L~..pr~vement has been petitioned for pursuant to <br />Subdivisioh 1~ When there has been no such petition, the <br />resolution~maY be adopted only by four-fifths of all members of <br />the CounCil. <br /> <br />IMPROVEMEN~S,~PETITION <br /> <br />When any petition for the making of any public improvement or in <br />opposition!to!any public improvement, the Council shall, by <br />resoluti~nl, d~termine whether or not the petition has been signed <br />by the r~q~ired percentage of owners of property affected <br />thereby, or as to the sufficiency of said petition. <br /> <br />APPEAL FROM DETERMINATION OF LEGALITY OF PETITION <br /> <br />Any person~, being aggrieved by the determination made in Section <br />210.01.6 above, may appeal to the district court of Anoka County <br />by servingi~upOn the Clerk of the City, within thirty days after <br />the adoption Of the resolution, a notice of appeal briefly <br />stating the g=ounds of appeal and giving a bond in the penal sum <br />of $250.00, i~ which the City shall be named as obligee, to be <br />approved by t~e Clerk of the City, conditioned that the appellant <br />will duly ~ro~ecure the appeal, pay all costs and disbursements <br />which may ~e adjudged against him/her, and abide by the order of <br />the court, fl The Clerk shall furnish the appellant a certified <br />copy of th~ p~tition, or any part thereof, on being paid by <br />appellanti ~f ~he proper charges therefore. The appeal shall be <br />placed upo~ t~e calendar of the next general term commencing more <br />than thi=tY d~ys after the date of serving the notice and filing <br />the bond a~d ~hall be tried as are other appeals in such cases. <br />Unless reversed upon the appeal, the determination of the Council <br />as to the ~uff, iciency of the petition shall be final and <br />conclusive, <br /> <br />COUNCIL PI~0CED.~JRE <br /> <br />Subdivision 1. Plans And S~ecifications. Advertisement For <br />Bid~. Wh'e~ th;e Council determines to make any improvement, it <br />shall cau.s~ plans and specifications of the improvement to be <br />made, or i~ previously, made, to be modified, if necessary, and to <br />be approved and.filed with the Clerk, and if the estimated cost <br />exceeds $~I0,00~ 00, shall advertise for bids for the improvement <br />in the newdpap~r and such other papers and for such length of <br />time as it i'~may~ deem advisable. If the estimated cost exceeds <br />$100,000.00, p~Ublication shall be made once in the newspaper and <br />at least °~ce in a newspaper or trade paper published in a city <br />of the fir~.t c~ass no less than three weeks before the last day <br />for submis~ion~of bids. To be eligible as such a trade paper, a <br />publicatiO~, sh~ll have all the qualifications of a legal <br />newspaperi ,~xcept that instead of the requirement that it hsall <br />contain genera! and local news, such trade paper shall contain <br />building and construction news of interest to contractors in this <br />state, am0~g w~om it shall have general circulation. The <br />advertisement Shall specify the work to be done, shall state the <br /> <br /> <br />
