Nowthen Boulevard <br />Ramsey, Minnesota 55303 <br /> <br />Re: Proposed Gateway <br /> Ordinance <br /> <br />North Industrial Airport Zoning <br /> <br />Dear Mr. Hartley: <br /> <br />Our law firm represents Waste Management of Minnesota, Inc. <br />("WMMII'), the present owner-operator of the Anoka Regional <br />Landfill located in the City of Ramsey, Anoka County. WMMI would <br />like to file this letter in the official record of the July 29, <br />1987 hearing which the City Council will consider as it <br />deliberates on the adoption of the proposed airport zoning <br />ordinance. The following comments will summarize the reasons why <br />WMMI feels that the ordinance should not be adopted by the City. <br /> <br /> By letter dated March 13, 1987 WMMI raised a number of <br />concerns with the proposed ordinance. A copy of that letter is <br />attached as Exhibit 1 and incorporated by reference herein. We <br />are also aware that Anoka County has expressed concerns to the <br />City about the proposed ordinance. Attached as Exhibit 2 and <br />incorporated by reference herein is a copy of the County's <br />letter. <br /> <br /> In addition to the concerns identified in the attached <br />letters, WMI would like to raise the following objections to the <br />adoption of the proposed ordinance: <br /> <br /> 1. The City cannot adopt the ordinance without prior <br />approval o~he Metr_9o~_~litan Council. Minn. Stat. § 473.806 <br />subd. 1 (1986) imposes development limitations upon sites which <br />have been identified for potential selection as future landfills <br />under the inventory and selection process created by the Solid <br />Waste Management Act of 1980.
