Per- <br />mission to d~velop specific parcels of land under the provisions which <br />follow shatl:_beibinding on all construction. Any proposed change in <br />the develoPment~plan after approval by the city council shall be resub- <br />mitted for ¢Ons{deration. ne land use, minimum lot area, yard, height <br />and accessOr~ uses determined by the planned unit development require- <br />ments shall ~re~ail over conflicting requirements listed elsewhere <br />within this eod~. <br /> <br /> pRELIbr{INARY DEVELO~ PLAN PROCEDURE <br /> <br />An applicant;r fo~ a planned unit development shall submit a preliminary <br />development ~la~ to the zoning officer with a written statement and a <br />certified ¢ ~h~ckior money order in an amount to cover all the costs <br />incurred l~ ~:he~king and processing such plans. ' <br /> <br /> L- I~,~thin sixty (60) days after the filing of the preliminary <br />plan with th;e zpning officer, the planning commission shall forward the <br />plan to th~ icitF council with a written report recommending that the <br />plan be d~ppr~ved, approved, or approved with modifications, stating <br />the reasonS',ifori these recommendations. <br /> <br /> ~ I~thin forty-five (~5) days after the receipt of the <br />application ~by ghe city council, a public hearing shall be held by <br />the city eOuncf~ on the application. The city council may continue <br />the hearin$'or ~efer the matter back to the planning commission for <br />further study;, ~rovided, however, that the public hearing or hearings <br />shall be con~clu~ded within forty-five (~5) days after the date of the <br />first public h~aring, unless the applicant shall consent in writing to <br />an extension of the time.
