Voting Yes: ~hairman Peterson, Commissioners Deemer, Kennen, <br />Zimmerman, La~ue and Hendriksen. Voting No: None. Absent: Commissioner <br />Johnson. <br /> <br />Case #5: Request To Subdivide B~ Metes And Bounds; Case Of Mr. David Guelker: <br /> <br />Mr. Jack Guelker was present representing his mother, Esther Guelker. Mrs. <br />Guelker,s'ihea~th, and the health of one of her sons, is failing and to insure <br />that her grandson has his home without dissension among the heirs, she has <br />given DaVid G~elker a quit claim deed to Parcel "A" which only has frontage on <br />an easement a~d is deficient in size. Filing of this parcel cannot be approved <br />without a ~ <br /> variance. <br /> <br />Mayor Ga~ec Was in the audience and stated that he resides behind the subject <br />property andis acquainted with the problems facing this family. Mayor Gamec <br />requested~th~t the Commission put some heart into the decision to approve or <br />disapprove the variance request. <br /> <br />Motion by Com~nissioner LaDue and seconded by Commissioner Kennen to recommend <br />approval Of Ms. Esther Guelker's request to subdivide by metes and bounds a <br />parcel of'la~d approximately 1.7 acres in size described as follows: <br /> <br />~nat parer of the Northeast 1/4 of the Southeast 1/4 of Section 14, <br />Township 32, Range 25, Anoka County, Minnesota described as follows: <br />Com~encing at a point on the South line of said Northeast 1/4 of <br />the Southeast 1/4 distant 10 feet East from the Southwest corner <br />said. Northeast 1/4 of the Southeast 1/4; thence East along said South <br />line a distance of 596.83 feet to a point distant 200 feet West from <br />the Wes~ line of the St. Francis Road; thence North and parallel with <br />the West line of said Northeast 1/4 of the Southeast 1/4 a distance of <br />120 feet; thence West and parallel with the South line of said <br />Northeast 1/4 of the Southeast 1/4 a distance of 596.83 feet to a <br />point l0 feet East of the West line of said Northeast 1/4 of the <br />Southeast 1/4; thence South and parallel with the West line of said <br />Northeast 1/4 of the Southeast 1/4 a distance of 120 feet to the point <br />of Co~encement. <br /> <br />Further~ that this motion is based on the fact that the applicant is a <br />homesteader and long time resident of the area. <br /> <br />Further Discussion: Chairman Peterson stated that there is an easement <br />issue that needs to be cleared up. Commissioner LaDue stated that the <br />Commission is dealing with property that was homesteaded in 1929; the <br />motion Can i~clude that the City will require an easement over Parcel C or <br />D if the 'street easement does not exist. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Kennen, <br />Zimmerman, LaDue and Hendriksen. Voting No: None.
