If <br />Counc~i d~letes the Westphal property from the permit, there <br />wouldi~av~ to be an amendment to the contract. If Council denies <br />the ¢~difiional use permit entirely, the Westphal property is out° <br /> <br />Mayor~Oam~c inquired if denial of the conditional use permit pulls <br />the W~tp~al property out for sure? <br />Mr. G~dr~ch replied that Mayor Gamec's previous statement is <br />corre¢~o ~!Deleting references to Westphal property from the <br />propelled Contract would make sure there is nothing which shows <br />that t~e ~ouncil is considering inclusion of the Westphal <br />proper.~y.ii Maybe Council even wants the record to show you are <br /> way <br />not adVoCating the Westphal property issue either . <br /> <br />Counc~lme~ber Van Wagner stated that she had no problem with the <br />propo~d ~ocument until Westphal property was included; could <br />appr~ of this contract if all references to Westphal property <br />were d~le~ed. <br /> Mr. MO~r~i~elder stated that in the course of negotiations of <br /> thisi!a~r~ment, one of the items that was a continuing concern to <br /> Mr. ~eV~e, Mr. Goodrich and Mayor Gamec, was the concern of <br /> prot~¢~ing Ramsey from liabilities from the current site and any <br /> addiCt~n~l site and that the parent corporation of Waste <br /> Management is on board in case anything goes wrong. One of the <br /> issu~s~ t~at came up was remedial action in connection with the <br /> old st~e,! Waste Management went back to the drawing board to <br /> prov~d~ ~ remedial action guarantee to R~msey and protect itself <br /> in some ~ashion in giving that guarantee. At that point, Waste <br /> Management came up with additional fill on the current operation, <br /> line~ i~nder that additional fill and a collection station on the <br /> WeS~h!al.lproperty; that is the process by which the Westphal <br /> prop~tYliwas included. Waste Management is in the process of <br /> closi~ ~ similar agreement with Anoka; one of the conditions <br /> to t~ir~,closing is that Waste Management will receive a <br /> condtfiio~al use permit to do environmental development on <br /> We~t@~allproperty and additional capacity on the piece south of <br /> the ~is~ing landfill. If that property is an issue, Waste <br /> Management can forget it or go forward. Waste Management's <br /> condt~io~ in paragraph 6.b is that we will have some assurance <br /> fromi~am~ey that if we have permits to go forward, Council will <br /> work wit~ us on developing it. Including the Wesphal property <br /> is n~ s~mething you are committing yourselves to tonight; it <br /> is n~ i~pediment to signing a document tonight. <br /> <br /> Co~!lm~mber Sorteberg stated that Council's feeling might be <br /> d~ff~en~ after they have seen Waste Management's presentation <br /> and~t~e'~elated public hearing. <br /> ~ ~ C/June 12, 1984 <br /> ~ Page 7 of 9 <br /> <br /> <br />
