Council~em~er Schlueter stated that she does not have that much <br />of a p~bl~m with leaving the Westphal property in the proposed <br />contra~ f~r now. <br />Mayor G,~me~ stated that his understanding of the situation is <br />that if thg conditional use permit is denied, Ramsey Council is <br />not agreeing, by the proposed contract to expand the landfill <br />Mr. Moersf&lder stated that Mayor Gamec's statement is correct. <br /> ; <br />Mr. Go*~lri~h stated that Ramsey still has to issue a conditional <br />use pe~it! for landfill expansion. The contract does not: obligate <br />RamseY~ ~o ~andfill expansion. Only the conditional use permit <br />can do tha~t. <br /> <br />Mr. otter iStated that Mr. Goodrich's statement is correct. <br />Mr. M°e;~rsfielder stated that Mr. Goodrich's statement is correct. <br />Council~en~ber Schlueter stated that the term 'shall' in the <br />contr$c~t g~.ves her an uncomfortable feeling. 'Shall in the <br />dicti~r~ar~ means 'obliged' . <br /> <br />Mr.:Go0dr:~ch stated that the proposed contract is based on <br />conti~endies and the term 'shall' does not come into play <br />unles~ :thai contingencies are fulfilled. <br /> <br />Motion ~:by iMayor Garnet and seconded by Councilmember Sorteberg to <br />adoPt~ReSglution #84-109 regarding the proposed contract for the <br />sale Of t~e City's interest in the existing landfill site and <br /> 80 a¢~s {~mmediately south. <br /> Furth~ D:l. scussion: Mr. Goodrich stated that if Council passes <br /> this r~so~ution,: Ramsey has given up: <br /> 1.
