I <br />I <br />I <br />I <br />I <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Mr. Oo~dr,~ch referred to Section 4.02.01 and stated that an <br />indiV~ua~ cann?t hold an elected office in the City and run <br />for~a~th~r off,ce at the same time; that person must resign <br />his/h~ ¢~rrent office. <br />Mr. H~tm~n noted that the resignation does not become effective <br />until ~heielection is certified. <br />Mr. O~dr~ch stated that this could allow for a council vacancy <br />betwe~ t~e time of election certification and the first day of <br />the y~ar.i <br /> <br />Mr. G~odr~ch also noted that the Charter allows Council to call <br />for a~'ilad~isory election on any question they deem appropriate. <br /> <br />Mr. GoOdr:.ch proceeded to review Chapter 5. <br /> <br />Mr. G~odr:.ch referred to Section 5.08 and inquired as to an <br />elect~ o:!ficer's recourse to oppose recall if he or she feels <br />they a~e ~nnocent of charges made. <br /> <br />Mr. Si~be~' replied that State statute says that if malfeasance, <br />misfe~an~:e or nonfeasance cannot be proved, the elected official <br />cannoti'be recalled from office. <br />Mr. ¢~drich stated that caution should be taken prior to initiating <br />a peti~i°~ to recall; the elected officer should be entitled to <br />a hea~ng if he feels he is not guilty. <br />Mr. G~dr~Lch proceeded to review Chapter 6. <br /> <br />Mr. G~dr.ch referred to Section 6.02.02 and the requirement that <br />Counc~ h .res and removes personnel by resolution; does this <br />apply ~o '~art-time personnel and what if a situation arises <br />whert ~ ~bstitute is called in to take the place of part-time' <br />persom~el~ <br />Mr. D~a ~tated that the City is getting to specific; just see <br /> that t~e ~ork gets done however the City sees fit. <br /> Mr. G~dr~ch referred to Section 6.02.01 and stated that Council <br /> can e~tab~ish departments, offices and agencies and prescribe <br /> their Eun~tions by ordinance. <br /> Mr. H~tm~n pointed out that the word 'may' is used and stated <br /> that ~unzil is not compelled to establish offices; the section <br /> was i~luted as a tool to be used by Council if there is a <br /> department that needs tightening up. <br /> <br /> Mr. G~odrich proceeded to review Chapter 7. <br /> <br /> Mr. GOOdrich stated that the City is required to adopt a long <br /> term flna~cial plan; there are certain before and after publication <br /> requirements assoczated w~th budget adoption and the City must <br /> adopt ~ p~rchasing policy by ordinance. <br /> <br />C/July 10, 1984 <br /> Page 11 of 13 <br /> <br /> <br />
