I
I
I
I
I
I
I
I
i
i

Commi~sio~Ler Deemer noted that the City is only required to
suppl~ilaqLearing notice to those residences within 350' of
the s~Je,:t area; he also noted that residents can request
publi¢~he. Lring notices on any issue they are particularly
intereSte, in even though they do not live within that 350'.

The Commi.~sion reviewed the finding of fact that have been
prepared :o this point.

CommiSsioner Deemer recommended the following as a finding of
fact: ~

#8 That at the regular Planning and Zoning Commission
M~eting of July 3, 1984, all persons wishing to
make a statement were invited to do so during
C{tizen Input.

Chairman peterson stated that he will entertain a motion for
City M~af~ to prepare further findings of fact based on
result~ o~ the June 25, 1984 public hearing and other information
gathered.

Mr LeFev
just ~tO p
of Pl~anni
it wo~td
terms~ Df
repre!sent

~re - Stated that Staff needs more direction than
repare findings of fact, particularly if the decision
,g and Zoning is to recommend denial of application --
be good for Staff to know what those reasons are. In
granting the permit -- know disputes of fact between
stives of applicant and members of public. There are
many i~su~s involved here and unless Planning and Zoning decides
to r~s~lv~ all of those issues against Waste Management, I
believe it would be inappropriate for City Staff and Attorney
to be pre ~aring a shotgun findings.

Chairman Peterson stated that the Commission can accept, reject
or amend the proposal they have before them and he will now
ente~tBin general discussion of which way this Commission wants
to go kee~ing in mind that the Commission is only recommending
and ~h'at {f any conditions of the permit agreement are amended,
the applicant has the right to not enter into that agreement.

The CommJJssion proceeded to review the Standards for Consideration
at this tlime.

a) The ~ature of the land upon which the use is to be located.

Chairman Peterson stated that Staff would address this from
a topography, soils, zoning and access point of view.

Commzsszoner Hendriksen referred to Commissioner Deemer's
reco ~m~.'.'en~ed finding of fact #8 and inquired as to the status
of that ~ecommendation.

Chairman iPeterson replied that when the findings of fact are
ready ~fo~ adoption as a package, the Commission can delete,
add ~= an~end to them. Com~,~ issioner Deemer's recommendation

standsl af

being proposed.

P & Z/July 3, 1984
