The conveyance documents shall be in such <br /> form acceptable to the City Council. <br /> <br /> The required dedication shall be made at time of final plat approval. <br /> <br /> The removal of trees, topsoil, storage of construction equipment, <br /> burying of construction debris, or stockpiling of surplus soils is <br /> strictly forbidden without the written approval of the Ci~, Council. <br /> <br /> ¢. Grading and utility plans, which may affect or impact the proposed <br /> , park dedication, shall be reviewed and approved by the Parks and <br /> ~ Recreation Commission prior to dedication, or at such time as is <br /> reasonably determined. <br /> <br /> ..f. To be eligible for park dedication credit, any land to be dedicated as a <br /> ' requirement of this Section shall be useable, developable land for use <br /> : : for park and recreation purposes and shall be at a location convenient <br /> to the people to be served. <br /> <br /> ~ Subd. 6. Cash payment. In lieu of land dedication, the City Council <br />may requ,'ir/: the subdivider to contribute a cash payment. The value of such payment shall <br />be the greater .atnount established by a specified contribution per dwelling unit or a percent <br />of fair m_ar~et V~alue of the undeveloped land commensurate with the percent of land which <br />otherwise,woUl.t:l have been required under {}9.50.37 Subd. 2 and {}9.50.37 Subd. 3 of this <br />chapter. "l~air Market Value", for purposes of this subdivision, shall be determined at the <br />time of apl= rOv~ of the final plat in accordance with the following: <br /> <br /> a. The City Park and Recreation Commission and subdivider may agree <br /> upon a recommendation to the City Council as to the fair market value <br /> based upon recommendation by the Assessor. <br /> <br /> Ip. The City Council after reviewing the Park and Recreation <br /> : Commission's recommendation, may agree with the subdivider as to <br /> the fair market value. If agreement is not reached in this manner, then <br /> fair market value shall be determined in accordance with the following: <br /> <br /> The fair market value as determined by the City Council based <br /> upon appraisals, accepted purchase agreements, comparable <br /> market transactions or other pertinent records as determined by <br /> the City Council. <br /> <br />The City Council, upon review and recommendation of the Park and Recreation <br />Commis.qi6_n Shall annually determine by resolution the park and dedication fee per <br />residential Unit. i <br />If, at the °l~tion*f of the City Council it is determined that a cash dedication shall be made, <br />said cashiShalI be placed in a special fund for Parks and Recreation use and deposited by <br />the developer ~'th the City prior to final plat approval. <br /> i Subd. 7. Combination of land dedication and cash payment. <br />In approP~;~ te l}.lats, a combination of land and cash may be required by the City Council. <br />In the evi*nt a c~mbination of land and cash is required, the amount of land to be dedicated <br />shall be ¢rgdittd against the total park dedication requirement and the remaining cash <br />contributio~n shall be based on the greater of the specified cash contribution per dwelling <br />unit or the Fair j'narket value of the land. When determining the cash contribution for the <br />remaining ~.cregge, the overall density of the plat shall be the basis for determining the <br />potential nqmb~r of dwelling units per acre. <br /> <br /> <br />
