Subd. 8. Scenic easements, in appropriate plats, as determined by <br />agreement between the City Council and the subdivider, the subdivider ma3, dedicate to the <br />public a scenic easement in combination with the requirements of §9.50.37 Subd. 2 and 3 <br />above or, if the subdivider and City Council a~ee, the scenic easement dedication may be <br />in lieu of up to ,5 zc of the requirements in §9.50._~7 Subd. 2 and 3 above. <br /> <br /> Subd. 9. Required improvements. Subdividers shall be responsible <br />for m',dd, ng certain improvements to the park. land the3' dedicate within their development for <br />park, playground and public open space purposes as follows: <br /> <br /> a. Provide finish grading and turf establishment for all park, playground, <br /> trail and public open spaces and provide landscape screening in <br /> accordance with City Policy. <br /> <br /> b. Construct and pave trails which are identified by the City as accessible <br /> bikeway/walkway trails in accordance with City Standards <br /> concurrently with the roads in their developments (i.e., grading with <br /> site grading and paving with street or parking lot paving). Grade and <br /> provide appropriate surfacing, as approved by the Park and Recreation <br /> Commission, of trails identified by the City as horse or wilderness <br /> trails. Park dedication credit will be given for construction of the <br /> trail(s) and associated improvements at a rate determined by the City <br /> Engineer. <br /> <br /> c. Complete, construct, and pave walkways which may be required as a <br /> trail link connector in accordance with City Standards. Such <br /> walkways may be within or abutting residential street right-of-ways. <br /> No park dedication credit will be given for these connecting links or <br /> construction thereof. <br /> <br /> d. Establish park boundary comers for the purpose of erecting park limit <br /> signs. Monuments of permanent character shall be placed by the <br /> subdivider at all angle and curve points on the outside boundaries of <br /> ail public property. <br /> <br /> e. Provide sufficient public road access and surfaced parking facility as <br /> deemed appropriate by the Park and Recreation Commission after <br /> consideration of the recommendation of the City Engineer for <br /> neighborhood parks and community parks. <br /> <br /> f. The subdivider shall submit a topographical, site, grading and <br /> landscape plan prepared by a re~stered engineer or landscape architect <br /> to the City for approval during the preliminary plat process. <br /> <br /> Subd. 10. Agreement as to dedication. Agreements as to the <br />requirements in §9.50.37 shall be made as part of a performance contract presented for <br />approval along with the final plat. Failure of the City Council and subdivider to reach <br />agreement regarding the matters in §9.50.37 above shall constitute denial of the plat. <br /> <br /> Subd. i1. Exceptions.
