. Sub& 4. Planned unit development (PUD's). Parkland <br />dedication lreqOirements for PUD's shall provide a minimum of ten percent (10%) for <br />public open sp~Ce and recreational uses or cash in lieu of land in addition to those special <br />requirements in~ §9.20.31. <br /> <br /> Subd. 5. Standards for accepting dedication of land for public <br /> <br />park purPoSe~s. <br /> a. <br /> <br /> Land proposed to be dedicated for public purposes shall meet the <br /> needs of the City. <br /> <br /> Prior to dedication for public purpose, the subdivider shall deliver to <br /> the City Anorney, an abstract of title or registered property abstract for <br /> such dedication. Such title shall vest in the Cit.,,, good and marketable <br /> title, free and clear of any mortgages, liens, encumbrances, <br /> assessments and taxes. The conveyance documents shall be in such <br /> form acceptable to the City Council. <br /> <br /> . ;. The required dedication shall be made at time of final plat approval. <br /> <br /> The removal of trees, topsoil, storage of construction equipment, <br /> buD, lng of construction debris, or stockpiling of surplus soils is <br /> strictly forbidden without the written approval of the City Council. <br /> <br /> e. Grading and utility plans, which may affect or impact the proposed <br /> park dedication, shall be reviewed and approved by the Parks and <br /> Recreation Commission prior to dedication, or at such time as is <br /> reasonably determined. <br /> <br /> : f. To be eligible for park dedication credit, any land to be dedicated as a <br /> i i requirement of this Section shall be useable, developable land for use <br /> for park and recreation purposes and shall be at a location convenient <br /> ~ to the people to be served. <br /> <br /> Subd. 6. Cash payment. In lieu of land dedication, the City Council <br />may requite th~ subdivider to contril~ute a cash payment. The value of such pay3nent shall <br />be the greater amount established by a specified contribution per dwelling unit or a percent <br />of fair m~ke~ ~,alue of the undevelt;ped land commensurate with the percent of land which <br />otherwi~/e[wo~ld have been required under §9.50.37 Sub& 2 and §9.50.37 Subd. 3 of this <br />chapter. '?airiMarket Value", for purposes of this subdivision, shall be determined at the <br />time of approV}tl of the tinal plat in accordance with the following: <br /> <br /> a. The City Park and Recreation Commission and subdivider may a~ee <br /> upon ~. recommendation to the City Council as to the fair market value <br /> based upon recommendation by the Assessor. <br /> <br />The City Council after reviewing the Park and Recreation <br />Commission's recommendation, may a~ee with the subdivider as to <br />the fair market value. If a~eement is not reached in this manner, then <br />fair market value shall be determined in accordance with the following: <br /> <br />The fair market value as determined by the Cit.',' Council based- <br />upon appraisals, accepted purchase a~eements, comparable <br />market transactions or other pertinent records as determined by <br />the City Council. <br /> <br />Itl, <br /> <br /> <br />
