. Sub& 4. Planned unit development (PUD's). Parkland dedication lreqOirements for PUD's shall provide a minimum of ten percent (10%) for public open sp~Ce and recreational uses or cash in lieu of land in addition to those special requirements in~ §9.20.31. Subd. 5. Standards for accepting dedication of land for public park purPoSe~s. a. Land proposed to be dedicated for public purposes shall meet the needs of the City. Prior to dedication for public purpose, the subdivider shall deliver to the City Anorney, an abstract of title or registered property abstract for such dedication. Such title shall vest in the Cit.,,, good and marketable title, free and clear of any mortgages, liens, encumbrances, assessments and taxes. The conveyance documents shall be in such form acceptable to the City Council. . ;. The required dedication shall be made at time of final plat approval. The removal of trees, topsoil, storage of construction equipment, buD, lng of construction debris, or stockpiling of surplus soils is strictly forbidden without the written approval of the City Council. e. Grading and utility plans, which may affect or impact the proposed park dedication, shall be reviewed and approved by the Parks and Recreation Commission prior to dedication, or at such time as is reasonably determined. : f. To be eligible for park dedication credit, any land to be dedicated as a i i requirement of this Section shall be useable, developable land for use for park and recreation purposes and shall be at a location convenient ~ to the people to be served. Subd. 6. Cash payment. In lieu of land dedication, the City Council may requite th~ subdivider to contril~ute a cash payment. The value of such pay3nent shall be the greater amount established by a specified contribution per dwelling unit or a percent of fair m~ke~ ~,alue of the undevelt;ped land commensurate with the percent of land which otherwi~/e[wo~ld have been required under §9.50.37 Sub& 2 and §9.50.37 Subd. 3 of this chapter. '?airiMarket Value", for purposes of this subdivision, shall be determined at the time of approV}tl of the tinal plat in accordance with the following: a. The City Park and Recreation Commission and subdivider may a~ee upon ~. recommendation to the City Council as to the fair market value based upon recommendation by the Assessor. The City Council after reviewing the Park and Recreation Commission's recommendation, may a~ee with the subdivider as to the fair market value.
