7. The estimated market value of each parcel as determined by the <br /> City Assessor following such dMsion of land and property must <br /> exceed the amount of special assessments previously levied and <br /> allocated to each parcel, including the amount of assessments <br /> estimated to be levied again in accordance with this section by <br /> reason of such division of land and property. <br /> <br /> Subd. S. Cily par~.ieipation, non.residential developments. <br /> <br /> a. Certain Improvements. The owner or subdivider, engaged in the <br /> development of lands and properties which are zoned for Non- <br /> Residential Districts, ma)' reques~ City participation in the payment of <br /> the costs of the installation of sanitary sewer, water system, storm <br /> sewer, streets and curb and gutter, park, trail and street light <br /> improvements required by this Section and, in such event, such owner <br /> or subdivider shall comply with the requirements of this Section. City <br /> participation shall be as determined by the City Council pursuant to a <br /> perfom-~ance contract. The Council shall, on a case by case basis, <br /> detem'dne infrastructure impact on areas outside the subdivision. City <br /> required oversizing of infrastructure beyond the appropriate standard <br /> residential or commercial equivalent shall be eligible for funding by <br /> the City. Source of City funding shall not be a determinate of <br /> financial participation. <br /> <br /> b. Assessments. The procedure for the installation and assessment of <br /> the cost of improvements under this Section shall be the same as that <br /> provided for improvements in areas zoned for Residential <br /> classifications pursuam to §9.50.50 Subd. 4 except that: <br /> <br /> t. Special assessments for the cost of sanitaw sewer, storm water <br /> and water system improvements shall be for a period of ten <br /> >,ears: and <br /> <br /> 2. The bond or letter of credit guaranteeing paymem of the special <br /> assessments for sanitary sewer, storm water and water system <br /> improvements shall obligate the owner or subdivider for the <br /> length of the assessment. <br /> <br /> Subd. 6. Subdivider may perform work, election. The owner or <br />subdivider may elect to construct the improvements required by this Section a~ his own <br />expense and without CiLv participation in the expense thereof, in such event, the owner or <br />subdivider max .... Performance contract. Prior to the installation of any <br />required improvements bv a subdivider and prior to Council approval of the final plat. the <br />subdivider shall enter into a contract v,.'ith the City, which contrac: shall require the <br />subdivider to construct said improvements at the sole expense of the subdivider and in <br />accordance with City approved constructions plans and specifications and all applicable <br />City standards and ordinances.
