Acting Mayor Peterson stated he is not in favor of the fence for added storage space be. cause other <br />businesses ma>, expecl to be able to do the same thing but have less building space and a larger <br />fenced storage area. <br /> <br />Mr. Nissen commented that the same tax base is present whether he has fenced storage or not. He <br />added that according to the ordinance, a fence constitutes storage. He also stated that he would like <br />Council to assess why a liquor store even needs 4,0{K) square feet to operate. He felt the ordinance <br />is antiquated and deserves review. He stated he did try to find other places to relocate his pawn <br />shop to but could not find an), reasonable enough in price. <br /> <br />Council agreed to review thc ordinance. <br /> <br />Zoning Administrator Frolik stated she reviewed Mr. Nissen's site and felt that it didn't make <br />sense to construct thc fence in the location Mr. Nissen indicated he would because this area was <br />landscaped. She added thc proposed storage area cannot be relocated to any other part of the site <br />because it would then interfere with off-street parking and loading areas. <br /> <br />Councilmember Beyer stated that June 25, 1991, Council granted permission to M.r. Nissen to <br />erect a fence for the remainder of his 4,000 ~uare foot requirement and over ~ year later, that has <br />not been completed. She felt Council had been quite lenient and patient with Mr~ Nissen. <br /> <br />Councilmember Hardin stated he was not opposed to giving Mr. Nissen a one-year extension to <br />comply with CiB, Code to which Councitmember Beyer stated she felt six moni:hs was plenty of <br />time to give Mr. Nissen. <br /> <br />Councilmember Hardin stated that M_r. Nissen already had the liquor business when he came to <br />City Council to request approval of his pawn shop, which Council approved. He suggested <br />Council take pan blame for Mr. Nissen ending up with too lirtie space for his liquor establishmem <br />because the Council ordinance was not reviewed closely enough at that time. He added that Mr. <br />Nissen's business is kept neat. <br /> <br />Councitmcmbcr Zimmerman felt that six months did not allow Mr. Nissen much time to look for <br />another building. <br /> <br />Mr. Nissen sated a year would allow him plen~' of time to find another location for his pawn shop. <br /> <br />Councilmember Bever felt Wing Mr. Nissen such an extension would be a detriment to other <br />liquor store owners. <br /> <br />Motion by Counciimember Hardin to renew Mr. Ralr~h Nissen's liquor license for one year with <br />the stipulation that between now and then Mr. Nissen will determine if his present lociition will <br />become tou-~ licmor store or total pawn shop. In the interim, City Council wilt be reviewing the <br />ordinance. If an amendment is made to the ordinance, it is possible that Mr. Nissen ma>' be in <br />comphance as is. <br /> <br />Motion failed for lack of a second. <br /> <br />Motion bv Counciimcmber Zimmerman and seconded by Councilmember Beyer to allow Mr. <br />Ralph Ni~sen, Ralr~h's Highway ~10 Liquor, ten months from JuN I, 1992 to comply with CiD' <br />Code by rnaksng his building all pawn shop or all liquor store. In the intehm, Ciw Council will be <br />reviewing the ordinance.
