Goodrich, City Attorney <br /> <br />6 <br /> <br />BackgrOund: <br /> <br />In June 1992, ~e City inadvertently attached the Chestnut Hill legal description to the <br />Wood Por~l Hil~s Development Agreement. This document was then recorded and is now <br />causing t{tl~ p~blems for the Chestnut Hill Plat. <br /> <br />To resolVei, thisiproblem the City needs to execute a Quit Claim Deed in favor of Good <br />Value Homes, 1Bc. for the lots in Chestnut Hill and record this deed. <br />In additiOn~ the !City needs to prepare an amended Development Agreement for the Wood <br />Pond Hills. sub~lvls~on and the City needs to prepare a Quit Claim Deed from WHP <br />Propertieg, t-Inc~! to Good Value Homes, Inc. for the underlying description of Chestnut <br />Hill. <br /> <br />Council ActiOn: <br /> <br />Motion tO authc~rize preparation and recording, at City's expense, of the above documents <br />and further LtO agthorize the Mayor and City Administrator to execute the Quit Claim Deeds <br />referenced aboV~e from the City to Good Value Homes, Inc. <br /> <br />Review Checklist: <br />City Attorney <br /> <br />CC: 11/24/92, <br /> <br />Copies also distributed to: <br /> <br />City Administrator <br />Zoning Administrator <br />Finance Officer <br /> <br /> <br />
