Also included is a memorandum from Ciw <br />Attorney, Bill .~oodrich regarding these provisions of the Code and finally attached is th'e <br />premises P~t application from the National Ataxia Foundation requesting a lawful <br />gambling ~ee~e at 6141 Highway #10 in Ramsey. You will recall that in early 1992, we <br />had sevea-al _n~e. tings regarding revision of the charitable gambling ordinances. When the <br />dust had! ltgttlegl, we ended up with a provision stating that 75% of the proceeds from a <br />gambling~pe~tion must be spent within the Ramsey trade area defined as the Cities of <br />Dayton, A~oP4, Andover, Ramsey and Elk River and the Township of Bums. Precedent <br />to finally !posing this ordinance provision, we had discussions about whether or not <br />national r~sea~ch met the intent of the ordinance. This occurred because there was an <br />existing la{~tful!lease at 6141 Highway gl0 held by the Cystic Fibrosis Foundation which is <br />a research brg~ization. It was my position at the time that since the lease existed prior to <br />adoption (~f tk/e ordinance, that Staff would not enforce provisions of the lease until <br />expirationiof the lease period. Most recently, City Staff was contacted by the National <br />Ataxia F°tindation, interested in a lawful gambling license. The Ataxia Foundation is also <br />a research orgahization. <br /> <br />Given the~ abo~e, Staff requests a reading from the City Council as to whether or not <br />national reseamh meets the intent of the ordinance provisions regarding expenditure of <br />proceeds raiSdd by the gambling organization. Referencing the letter by Attorney <br />Goodrich, ii ~lieve he is stating that, void any case taw or statutory language on the <br />subject, the issue becomes one of policy at the Council table; hence the question. <br /> <br />Recommendation: <br /> <br />Staff is recommending consideration of the following: 1) A motion stating that national <br />research ribes/floes not meet the intent of trade area expenditure pursuant to 7.61.10 of <br />Ramsey City ~C~ode; 2) the Ramsey City Council hereby recommends approval/denial of <br />the lawf~!;gan~bling license application of the National Ataxia Foundation; and 3) the <br />Ramsey Cit3' COuncil hereby recommends approval/denial of a contemplated future lawful <br />gambling ~pti~ation from the existing Cystic Fibrosis Foundation operation. <br /> <br />Council Action: <br /> <br />I <br /> <br />Motion stating ~hat national research does/does not meet the intent of trade area expenditure <br />pursuanttO 7,6~.10 of the Ramsey City Code. <br /> <br />Motion recommending approval/denial of the lawful gambling license application of the <br />National Aiaxia foundation <br /> <br />Motion recommending approval/denial of a contemplated future lawful gambling <br />application from the existing Cystic Fibrosis Foundation operation. <br /> <br />Reviewed by: <br /> <br />City Admi~trator <br /> <br />Copies also distributed to: <br />Finance Officer <br /> <br />cc: I <br /> <br /> <br />
