I I I I Councilrnember introduced the following resolution and moved for its adoption: RESOLUTION #92-10- RESOLUTION iAUTHORIZING VACATION OF STREET RIGHT-OF-WAYS BETWEEN IPARCELS DESCRIBED AS PINS 28-32-25-31-0003 AND 28-32.25- 31-0004 WHEREAS, certain street right-of-way easements had been acquired by the City in 1977; and WHEREAS, certain street easements are no longer necessary for use by the City and public; and WHERE.~S, the original need by th,e_ City for said easements has been replaced by other easements Which a~equately address the City s requirements; and WHERE,~S, the owners of parcels known as PINs 28-32-25-31-0003 and 28-32-25-31- 0004 have requestc~t that the City vacate said easement; and WHEREAS, M.S.A. 412.851 entitled Vacation of Streets permits the City Council to vacate public grouflds and public ways; and WHEREAs, on October 6, 1992, the Planning and Zoning Commission held a public hearing reg--_ ding ihe issue of vacating said easement between these lots, which public hearing was preceded bgtWo Weeks public notice in the Anoka County Union and posted notice, and at which · ~'r public hearing:M1 .[members of the pubhc present ere given the opponumty to be heard; and WHEREAS, after consideration of all relevant factors, the City Council finds that it is in the best interest of!the public to vacate said street right-of-way easements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ~NOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the street right-of-way easement legally described as follows is hereby vacated to wit: Aa easement for road purposes 50 feet in width over that pan of the Northeast Qaart~r of the Southwest Quarter of Section 28, Township 32, Range 25, Anoka C0un~, Minnesota, the center line of which is described as follows: Beginfiing at the point of intersection of the west line of said Northeast Quarter of the So~uthwest Quarter with the southerly right of way line of the Burlington Nerth .egn Railroad; thence southeasterly along the south right of way line of the said BUtrling. ton Northern Railroad, a distance of 366.80 feet and to the actual point of be~nr~mg of said center line; thence southwesterly to a point on the northerly right of: wa~ line of U.S. Trunk Highway No. 10, said point being located a distance of 300 f{et as measured along said right of way from the west line of the said N0rthQast Quarter of the Southwest Quarter. 2) That the City Administrator is hereby directed to prepare a Notice of Completion of the Pro¢Cedin~gs in conformance with M.S.A. 412.851. The City Administrator is then dire¢ ,ted t6. record the Notice of Completion with Anoka County to have said portion of draina:ge e~sement removed from the title of said property.
