Councitmember its adoption: introduced the following resolution and moved for RESOLUTION #92-09- A RESOLUTION APPROVING THE ISSUANTC~ OF AN AMENDED CONDITIONAL USE PERMIT TO DANNY'S ALUMINUM PROCESSING, INC.BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF CONDITIONAL U~ PERMIT (Draft Date 9/16/92) WHEREAS, the consideration of approval for the request for a conditional use permit amendment is based on the City's determination that the result of the amendment will reduce the level of non-conformity of the subject facility as it currently exists and upgrade site opertions to a standard beyond that currently required by City Code; and WHEREAS, the terms of me conditional use permit, as it is proposed, constitutes a reduction, versus an expansion, of the site operations as they currently exist. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On ,1992, an amended conditional use permit ("CUP") was approved for issuance by the City of Ramsey ("City") to Danny's Aluminum Processing, Inc. ("Permit Holder") to operate an aluminum processing facility that includes the disassembly of engines and transmissions and collection services for other non-hazardous metals and batteries on the property generally known as 14050 Basalt Stree N.W. and legally described as follows: Lot s 1, 2, and 3, Block 4, Gateway North Industrial Park Plat #2, Anoka County, Minnesota; hereinafter "site". This permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as follows: Term. This permit shall remain in effect so long as the conditions imposed herein are complied with. Noise. Noises emanating from the site and operations shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010.0080, as amended except as modified herein by City performance requirements. Dust/Ash/Particulates. The emission of dust, ash or other particulate matter shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0010 to 7005.0080, 7005.2770 subp. 2.A and 40 CFR Part 50, as amended except as modified herein by Ciry performance requirements. Odor. The emission of odor from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as modified herein by Cit3, performance requirements.
