Councilmember introduced the following resolution and moved for its adoption: RESOLUTION g92-08- RESOLUTION GRANTING APPROVAL OF A DIVISION OF LAND BY A METES AND BOUNDS DESCRIPTION BY SIDNEY V. AND MARLYS M. SCHAUMBURG WHEREAS, Sidney V. and Marlys M. Schaumburg applied to the City of Ramsey for a division of land by a metes and bounds description; and WHEREAS, Section 9.50.09 of the Ramsey City Code prohibits the division and conveyance of land by metes and bounds description; and WHEREAS, Section 9.50.09 of the Ramsey City Code provides for City Council to waive compliance when compliance will create an unnecessary hardship and failure to comply does not interfere with the purposes of Chapter 9.50 (Subdivision); and WHEREAS, the subject property is approximately 35.5 acres in size and the applicant desires to convey a 15.5 acre parcel to developer, Good Value Homes, Inc., for future development; and WHEREAS, the property legally described below is within the City's Municipal Urban Service Area and it is anticipated that the property will be platted and developed in accordance with Chapter 9.50 of the Ramsey City Code in the very near future: The Southwest Quarter of the Northeast Quarter of Section 26, Township 32, Range 25, according to the United States Government survey thereof and situated in Anoka County, Minnesota, except the West 440 feet of the South 330 feet thereof. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council approves the division of the above legally described property by metes and bounds description to create the following legally described property: The South Half of the Southwest Quarter of the Northeast Quarter of Section 26, Township 32, Range 25, according to the United States Government survey thereof and situated in Anoka County, Minnesota, except the West 440 feet of the South 330 feet thereof. The motion for the adoption of the foregoing resolution was duty seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly passed and adopted by the Rarnsey City Council on the 25th day of August, 1992. /40 Resolution River Bluffs P.U.D.
