improvements, except for those Stage II Improvements constructed by the CITY. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />5 <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />City Code Com_oliance. That the DEVELOPERS will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br />Confornlance with Plan. The Plat. shall be developed pursuant to the final plat <br />consisting of three (3) sheets, prepared by Hakanson Anderson Associates, Inc., <br />entitled Rivenwick and dated ,1992. <br /> <br />Incornoration of All City Code Requirements. That the recitals above and <br />the provisions of the City Charter, Subdivision Code, Zoning Code and Public <br />Improvement Code of the CITY as amended to date hereof, are incorporated herein <br />by reference. <br /> <br />Stage I Improvements Required. The DEVELOPERS agree to construct <br />the required Stage I Improvements according to the terms and conditions of this <br />contract and in accordance with DEVELOPERS' plans submitted to the CITY, <br />Said plans shall be in general conformance with the Grading Plan prepared David J. <br />Nash and dated June 22, 1992. The final construction plan for sanitary sewer, <br />storm sewer, watermain, and street improvements shall be submitted to the City <br />Engineer for review and approval prior to construction. The City Engineer shall <br />have complete access and oversight authority over all phases of construction of the <br />project. Stage I Improvements shall not be considered complete until accepted by <br />the City Engineer. The Developers shall be responsible for all costs associated <br />with extending public utilities under 137th Avenue N.W. from Dolomite Street <br />N.W. to the eastern plat boundary and providing ten (10) service stubs. <br /> <br />Construction of Riverdale Drive N.W. Riverdate Drive N.W. shall be <br />constructed in accordance with Municipal State Aid specifications and in phases as <br />shown in Exhibit A. Phase I shall be constructed concurrently with Stage I <br />improvements described in Paragraph 4, at the DEVELOPERS expense. The <br />CITY shall credit, in favor of the DEVELOPER, the cost of pavement <br />construction greater than a thirty-six (36) foot wide street between Feldspar Street <br />N.W. and Riverdale Drive N.W. and Garnet Street N.W. and Riverdale Drive <br />N.W. in Phase I against Phases II and III of Riverdale Drive N.W. The <br />DEVELOPERS shall be responsible for rough grading the remaining portion of <br />Riverdale Drive N.W. beyond Phase I by December 31, 1992. <br /> <br />Phase II of Riverdale Drive N.W. shall be constructed at such time as any one of <br />Outlots B, F or G are further subdivided or developed. The DEVELOPERS <br />agree to be assessed the cost of a thirty-six (36) foot, 9-ton design road, including <br />curb and gutter and storm sewer.
