,I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br />I <br />I <br /> <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - RIVENWICK <br /> <br /> THIS' AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a m~nieipal corporation of the State of Minnesota (the "CITY"), and FAYE <br />CONSTRIJII2TION COMPANY, A MINNESOTA PARTNERSHIP, whose address is <br /> <br /> and <br />MINNESOTA CORPORATION, <br />DEVELOP'ERS"). <br /> [ <br /> WITNESSETH: <br /> <br /> MAX SCHWARTZMAN & SONS, INC., A <br />whose address is ("the <br /> <br /> WHEREAS, the DEVELOPERS are the fee owners of the following described property <br />situated in the !21"I~ OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br /> <br />as follows: <br /> <br /> RIV~NWICK, Anoka County, Minnesota <br /> <br />the "SubjeCt PrOl~ty"; and <br /> <br /> WHEREAS, on July 28, 1992, pursuant to Resolution 92-07-181, the CITY approved <br />the final plat of the Subject Property which plat is known as RIVENWlCK (the "Plat") <br />contingent on cer~a, in requirements, including DEVELOPERS and CITY entering into this <br />contract; and <br /> <br /> WHEREAS, the final plat for the Subject Property conforms to the preliminary plat for <br />Faye 2nd Addition ~aka Rivenwick) as approved by the CITY on April 23, 1991; and <br /> <br /> WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow <br />requirementS have been fulfilled by DEVELOPERS; and <br /> <br /> WHEREAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" <br />Improvements ~vhiCh definition is used herein when reference is made to "Stage I" and "Stage 11" <br />ImprovementS; :and' <br /> <br />WHEREAS, the DEVELOPERS desire to construct the Stage I and Stage II <br /> <br /> <br />
