AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES This Agreement is made this__ day of , 1992 between: The City of Ramsey, Anoka County, Minnesota hereinafter called "THE CITY" and Maier Stewart & Associates, Inc. a professional corporation with offices at: 1959 Stoan Place St. Paul, Minnesota 55117 hereinafter referred to as "THE ENGINEER". WHEREAS, THE CITY is authorized and intends to employ the services of THE ENGINEER from time to time in the construction of public works and in providing general engineering services for THE CITY, and WHEREAS, the services will include in some instances single construction projects comprised of a full project sequence to include the development of reports, plans and specifications, bidding documents, contract administration and construction inspection, and WHEREAS, in other instances the work may vary and not include the full project sequence, and WHEREAS, it is intended that this Contract shall govern the terms of employment of THE ENGINEER and all the conditions thereof, and THE CITY desires to engage the services of THE ENGINEER in connection with said work: NOW, THEREFORE, IN CONSIDERATION of the mutual covenants of this Agreement as set forth herein, IT IS AGREED BY and between the parties as follows: Section I. THE CITY hereby employs THE ENGINEER to furnish and perform the professional services hereinafter specified, subject to the conditions noted herein below; and THE ENGINEER agrees to render and perform any and all engineering services in connection with any of the above-mentioned work, in the manner and subject to the conditions noted herein. Section II. THE ENGINEER, upon direction of THE CITY, agrees to perform the following Enqineering Services for Proiects: Ao General: THE ENGINEER shall serve as THE CITY's professional represen- tative in the planning and general review of construction of the Project, and shall give consideration and advice to THE CITY during the performance of his services.
