(2) <br /> <br />Payments Withheld from Contractors: No deduction shall be made <br />from THE ENGINEER's compensation on account of penalty, liqui- <br />dated damages, or other amounts withheld from payments to <br />Contractor. <br /> <br />(3) <br /> <br />Abandoned or Suspended Work: If any work performed by THE <br />ENGINEER is abandoned or suspended in whole or in part, THE <br />ENGINEER shall be paid for any services performed on account of it <br />prior to receipt of written notice from THE CITY of such abandonment <br />or suspension, together with any terminal expenses resulting there <br />from, all as shown on Schedule B attached hereto and incorporated <br />herein by reference. <br /> <br />Compensation for Basic Services of the EnQineer: THE CITY shall pay <br />THE ENGINEER for the basic services described in Section II.B. of this <br />Agreement. A basic fee representing a maximum not to be exceeded amount <br />shall be negotiated between THE CITY and THE ENGINEER. The basis for <br />calculating this fee may be shown on Schedule A being a percentage of the <br />cost of the Proiect. At the completion of each phase of the work, progress <br />payments based upon hourly rates shall not exceed the following per- <br />centages of the negotiated fee for the project. These percentages reflect a <br />cumulative amount of compensation with 100% representing the total <br />negotiated fee for the project. <br /> <br />(1) <br /> <br />Feasibility: This work shall be billed on the basis of the salary costs <br />times a multiplier as outlined in Schedule B. The costs shall not <br />exceed 15% of the maximum fee negotiated or a predetermined <br />amount agreed upon by THE CITY and THE ENGINEER. <br /> <br />(2) Contract Documents: 75 percent of the negotiated fee. <br /> <br />(3) Receipt of Proposals: 80 percent of the negotiated fee. <br /> <br />(4) During Construction: 95 percent of the negotiatedfee. <br /> <br />(5) <br /> <br />Completion of Project: Balance of negotiated fee upon receipt by the <br />City of record drawings. <br /> <br />Attendance at Council Meetinqs: The Engineer shall be available to attend <br />City Council meetings to discuss general items of an engineering nature <br />where he shall provide advice and recommendations on issues affecting the <br />Engineer's work. The fee for attending such meetings shall be as shown by <br />Schedule B. <br /> <br />_P. ayment for Extra Services of the. Engineer: For extra services defined in <br />Section II.C. THE CITY shall pay THE ENGINEER on an hourly rate basis. <br /> <br /> <br />
