Motion by Councitmember Peterson and seconded by Councilmember Beyer to adopt the <br />Resolution #92-01-019, as amended, revoking the Conditional Use Permit issued to 14600 <br />Nowthen Boulevard N.W. for an auto sales/repair operation. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson and Beyer. Voting <br />No: Councilmember Zimmerman. Abstaining: Councilmember Hardin. <br /> <br />Case #7: <br /> <br />Follow-up Discussion Regarding <br />December 27, 1992 Relating to <br />Cowles Addition <br /> <br />Zoning Administrator Memo Dated <br />Non-Conforming Structures/Uses in <br /> <br />Zoning Administrator Frolik stated this was a follow-up to her memo dated December 27, <br />1991.regarding nonconforming structures and uses in the newly platted Cowles Addition. Ms. <br />Frolik stated that she discussed the results of her research with the City Attorney on at least three <br />occasions and he indicated that he was in agreement with her position on the issue. However, Ms. <br />Frolik stated that she did not give the City Attorney the opportunity to review her memo on this <br />same matter prior to its issuance on December 27, 1991. <br /> <br />Consensus of the Council was for Ms. Frolik to not spend any more time relating to this issue. <br /> <br />Case #8: Adopt Ordinance Amending Chapter 7 of the City Code entitled <br /> "Charitable Gambling" and "Bingo" <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Hardin to adopt Ordinance <br />#92-01 amending Chapter 7, Sections 7.61 entitled "Charitable Gambling" and 7.62 entitled <br />"Bingo". <br /> <br />Motion carried. Voting Yes: Councilmembers Beyer, Hardin, Peterson and Zimmerman. Voting <br />No: None. Abstaining: Mayor Gilbert.son. <br /> <br />Case g9: Legal Services <br /> <br />City Administrator Schroeder stated that the Budget Committee is recommending adopting the <br />resolution appointing legal firms for the years 1992, 1993 and 1994; however, concern was <br />expressed regarding placing a cap on prosecution services on an annual basis. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to adopt Resolution <br />g92-01-020 appointing legal furas of Randall, Dehn & Goodrich for general legal and prosecution <br />services and Holmes & Graven for Bond Counsel, Tax Increment Financing and related legal <br />services for the years 1992, 1993 and 1994. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Hardin and <br />Zimmerman.
