He inquired of Mr. Gallagher if he intends to reimburse the City in the amount of $121.41. Mr. Galiagh~ replied he has no intention of reimbursing the City. (PIN 25-32-25-23- ;0006) The Mayor ~nd ~ouncil reviewed the findings of fact presented by Ms. Frolik and requested the following ar~enfll'nents: Add a finding to read "That on January 6, 1992, a letter was sent to Mr. Geral.,d, RO~_ttadvlsing him of this public hearing; no response from Mr. Root. Add a finding to read 'Gerald,' R0bt was not present at the public hearing; Stanley (Butch) Browning appeared stating he W~ M~ .~. Gerald Roofs representative. Motion by C, ~un~ilmember Peterson and seconded by Councilmember Beyer to adopt Resolution 4t92-01-0~8 ~ top~g Findings of Fact ~t0305, as amended, to revoke the conditional use permit for auto sales/r~' .air ~sued to 14600 Nowthen Boulevard N.W. Further diScu~si0,: Councilmember Zimmerman felt that Mr. Browning is a victim of Mr. Gerald Root not m~ ing ~he conditions of the permit known to him. Upon inquiry by Mr. Browning, City Anomey Go~ driC~h stated the City has now conducted a public hearing. City Staff has proposed a findings oflf~ ~t b~ed on the record of the happenings at the property and Council is now about to vote on whether t~, continue or revoke the conditional use permit. Mr. Fred Dinnetz, a co-leasee of the propert~ ~ithi,,Mf. Browning, stated he is more than willing to make site improvements to the property. {24un¢~I s reply to Mr. Dinnetz was that it appears the conditional use permit will be revoked a_nfl Mr,' Root will be given 90 days to vacate the use from the property; however, another option to the~}~}ro~erty owner is to apply for a new conditional use permit for auto repair only. If that is the in~nfi~ of the property owner and the leasees, then they should plan to resolve the new CUP by the etj~d ~f April 1992 and in the interim begin to make improvements to the condition of the premise~,~ Cduncil noted that application for a new CUP does not necessarily mean that'it would be aPpJ'ove~:l; however, the City is willing to work with the leasees.
