Ahy ~mounts due hereunder for municipal water or sanitary sewer <br />ct$arg~es plus 10% interest may be collected in an action brought for that <br />p~arP~_se in the name of the City; or the Clerk may certify to the County <br />At~di~or the amount due for municipal water and sewer charges plus <br />1~%- ;I,/;~terest, together with the legal description of the premises served <br />a0d the County Auditor shall thereupon enter such amount within the <br />t~x le.¥y on said premises collectible with the taxes for the ensuing year, <br />p~ovi~ted, however, that nothing herein shall change the provisions of <br />tliis Ordinance with reference to shutting off water for the non-payment <br />o~a ~ater bill. <br /> <br /> 7. ~en the applicant or consumer wants to terminate his water service, <br /> h~ s.h~ll notify the City to turn off his water service. The meter shall be <br /> r~ad'~t that time to determine the final bill. <br /> <br /> 8. In allicases where water has been turned off for the nonpayment of bills <br /> o~~ fo~ violation of any rules or regulations of the City, such water shall. <br /> n~t be again turned on unless and until such bills have been fully paid <br /> PI~s ~0% interest, and all delinquent charges removed and a charge for <br /> t~rnii~g such water on has been paid. <br /> <br /> SECTION 5 <br /> VARIANCES <br /> <br />The Coun¢i! may permit variances from the strict appliance of any of the <br />provisional o~ tl%~s ordinance if it is satisfied that there are special circumstances <br />or condition~ a~ecting the premises for which the variance is requested and that <br />the grantin~ of ~uch variance will not materially affect adversely health, safety or <br />general w~Ifareior public or private property. Any variation permitted under this <br />provision m~st be noted on the permit. A public hearing is not required. <br /> <br /> SECTION 6 <br /> PENALTIES <br /> <br />Any person!violating any provision of this ordinance shall be guilty of a gross <br />misdemeanor a~d shall be punished as law provides for such offense. Each day <br />the violatiOi~ cohtinues shall constitute a separate offense. Any person violating <br />any of the ~ro~sion of this ordinance may also be held liable to the City for any <br />expense, los~ or~ damage occasioned the City by reason of such violation. <br /> <br />Page 13 <br /> <br /> <br />
